RESOLITIO -N0. 634 -� Resolution abandoning and closing portion of alley, which said alley runs from Third Avenue to "G" Street in the City of Chula Vista, Cali- fornia, as shown and delineated upon Map 1206 filed in the office of the County Recorder of San Diego County, California, September 14, 1909. WHEREAS, the San Diego Fruit Company, a corporation, and the San Diego Land Company, a corporation, on or about September 14, 1909 filed in the office of the County Recorder of San Diego County Map 1206, which had delineated thereon certain streets and alleys ; and WHEREAS, said streets and alleys were accepted for public use by the Board of Supervisors of the County of San Diego in said year 1909 ; and WHEREAS, there is delineated upon said map an alley running from Third Avenue to "G" Street in said City of Chula Vista, which said alley since the date of acceptance of said Map has been known and used as a public alley; and WHEREAS, the City Council of the City of Chula Vista, on the 12th day of January, 1942, passed and adopted a resolu- tion of intention to close a portion of said alley; and WHEREAS, notice of the passage of said resolution was posted upon and along said portion of said alley and pub- lished in the Chula Vista Star, a newspaper of general circula- tion in the City of Chula Vista, as required by Section 3 of the Street Improvement Law of 1899 (Deering's General Laws, Act 8195, Section 3) , all as shown by affidavit of publication and posting on file with the Clerk of said City of uhula Vista; and 'WHEREAS, no objections have been filed to the closing of said portion of said alley; and WHEREAS, after investigation and consideration by this Council, it appears that public interests, necessity and conven- ience require and that it would be for the best interests of the public that a portion of said alley hereinafter in this para- graph particularly described, be closed and abandoned. The said portion of said alley intended to be closed and abandoned is described as follows: The westerly end of that certain alley running from Third Avenue to "G" Street as delineated and shown on map number 1206, filed September 14, 1909 in the office of the County Recorder of San Diego County, and described by metes and bounds as follows: Beginning at the southeasterly corner of Lot one (1) in Block six ( 6) of Chula Vista ' Villa Tract number Tw8, according to Map 1206 thereof; thence S. 13 16' East 23.05 ft; to the northeasterly line of Lot twenty (20) in said Block six (a) ; thence along said line North 73° Ye. Qs I37 �-a 52' West 45.89 ft. to the most northerly corner of said Lot Twenty t20) on the easterly line of said Third Avenue; thence along said line North 18° 31' West 24.31 feet to 03.e south- westerly corner of said lot one (I) ; thence along the southerly line of said Lot 1 South 73° 52' east forty-eight and 44/100 feet (48.44 ft. Y to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF SAID CITY OF CHULA VISTA, AS FOLLOWS, TO WIT: That a portion- of that certain alley running from Third Avenue to "G" Street, as shown and delineated upon that certain Map 1206 filed in the office of the County Recorder of San Diego County, September 14, 1909, be and the same is hereby forever abandoned and closed to the public use; said portion of said alley abandoned and :closed to public use being hereinabove described by meted and bounds. IT IS FURTHER RESOLVED that no property is to be taken or damaged and no assessment it to be made in closing said portion of said alley. PASSED, ADOPTED AND APPROVED BY THE CITY COUNCIL. OF THE CITY OF CHULA VISTA, CALIFORNIA, the day of March, 1942, by the following vote, to wit: AYES: Councilmen Perkins, Ba.rnside, Howe, Dupree.
