HomeMy WebLinkAboutReso 1942-624 _.., i _ RESOLUTION NO. 624 • Resolution of intention to close portion of alley, which said alley runs from Third Avenue to "a" Street in the City of Chula Vista, California, as shown and delineated upon Map 1206 filed in the office of the County Recorder of San Diego-County, California, September 14, 1909. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, AS FOLLOWS, TO WIT: WHEREAS, the San Diego Fruit Company, a corporation, and the San Diego Land Company, a corporation, on or about September 14, 1909, filed in the office of the County Recorder of San Diego County, Map No. 1206, which had delineated thereon dertain streets and alleys; and WHEREAS, said streets and alleys were accepted for public use by the Board of Supervisors of the County of San Diego in said year 1909; and WHEREAS, there is delineated upon said Map an alley running from Third Avenue to "a" Street in said City of Chula Vista, which said alley since the date of acceptance of said Map has been known and used as a public alley; and WHEREAS, after an investigation and consideration by this Council it appears that public interests, necessity and convenience require and that it would be for the best interests of the public that a portion of said alley herein- after in this paragraph particularly described be closed and abandoned . Said portion of said alley intended to be closed and abandoned is described as follows: The westerly end of that certain alley running from Third Avenue to "G" Street as delineated and shown on map number 1206, filed September 14, 1909 in the office of the County Recorder of San Diego County, and described by metes and bounds as follows: Beginning at, the southeasterly corner of lot one (1) in Block six (6) of Chula Vista Villa Tract number Two; according to map 1206 thereof; thence 8 13° 16' East 23.05 ft; to the northeasterly line of lot twenty (20) in said Block 6; thence along said line North 73° 52' West 45.89 ft to the most northerly corner of said lot 20 -on the easterly line of said Third Avenue; thence along said line North 18° 31' West 24.31 ft to the southwesterly corner of said lot one (1) ; thence along the southerly line of said lot 1 South 73° 52' east forty-eight and 44/100 feet (48.44ft) to the point of bettnning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF SAID CITY OF CHULA VISTA, that it is the intention of • • said City Council to close a portion of that certain alley running from Third Avenue to "G" Street in the City of Chula Vista, which said alley is shown and delineated upon that certain map 1206 filed in the office of the County Recorder of said San Diego County, California, September 14, 1909; said portion. of said alley intended to be closed being hereinabove particularly described by metes and bounds in paragraph four hereof; and BE IT FURTHER RESOLVED that Lynn Love, Street Superintendent of the City of Chula Vista, be and he is hereby authorized and directed to post and publish notice of the passage of this resolution as provided in para- graph three of the Street Improvement Law of 1899 (Deering General Laws, Act 8195, paragraph three); and BE IT FURTHER RESOLVED that said Lynn Love, Street Superintendent of the City of Chula Vista, be and he is hereby authorized and directed to publish said notice of the passage of this resolution as provided in paragraph three of the Street Improvement Law of 1899 (Deering General Laws, Act 8195, paragraph three) in the Chula Vista Star, which said newspaper is hereby designated by this Council as said newspaper most likely to give notice of the closing of a portion of said alley to all those interested therein. PASSED, ADOPTED AND APPROVED BY THE CITY COUNCIL • OF THE CITY .OF CHULA VISTA, CALIFORNIA, the 12th day of January , 1942, by the following vote, to wit: AYES: Councilmen Timmons, Dupree, Perkins, Burnside, Howe.
