Asseinbly Dill 1733 amending California Penal Code Section 326.5 relating to
Bingo has been adopted and ti•+ill become effe[tive January O1 , 1930.
41e have reyuested County Counsel make the necessary changes in the San Diego
County Code of Regulatory Ordinances to mal:e it conform to the ne�r state law.

1. A copy of Assembly Bill 1733. You will note the neri sections are
underlined. .
2. An updated E3in90 information sheet.
3. New financial statements for all .organizations not exempted by 23701(d) .
of the Rev�nue and Taxation Code. ��ote you may now deduct ten percent of
the praceeds or b500 per month, rrhichever is less , DCFORE the deduction
for prizes, for expenses. You may also include the purchase of bingo
equipment and the licensing fees as deductible expenses.
4. A htonthly Recap of gross receipts wY�ich must be completed and submitted �
by all organizations at the end of each month �iith your financial
statements for that month. If your gross receipts for any month exceed �
55,000, an additional fee of one percent of the amount collected over
55,000 shall be forwarded to the Sheriff with your statenents.

l'his bill K�ould, instead, proviJe that t6e purtion of the proceeds
used (or such expenses no� exceed 109 before the deduction for
prizes or $500 per month, whichever is less, w�ould provide that
overhead includes �he purchase uf tiingo equipment, and would
permit proceeds lo be usrd �o pay license fees. The bill w•ould specify
tha� the license fee shall not exceed S50 annually, unless lhe city,
county,or city and rnunty chooses lo im�se a S�O license applicalion

The California Penal Code autho�•izes counties or cities r:ithin the stale to
adopt ordinances permitting certain authorized organizations to conduct binro
games when the proceeds , riith soecified exceotions , of all such cames zre to
be used only for charitable pur•poses.
The County of San Diego has adopted such ordinance na4;in9 birgo lepal under
the terms and conditions set forth in the ordinance and the Californiz Penal
Code.
GEIJERAL IIJFORiiATION •
1. Dingo is defined as a game of chance in �•�hich prizes ar-e ao-�arded on the
basis of desianated numbers On a card o,hich conform to numhers or svmbols
Selected at random. 6inqo shall also include cards havinn numbers a'
symbols ��ihich are concealed and preprinted in a manner providine tor disu-ibu-
tion of prizes. The ��innin9 cards shall not be 4;norm ��rior to the name hv
any person participating in the playina or operation of Lhe binno naire. f�ll
such preprinted cards shall bear the le9end "for sale or use orly in a hinpo
game authorized under California lav� pursuant to local ordinance".
2. It is unlao-iful for any person to conduct any bingo game in the unincorpor-
ated area of San Diego County unless that person is a member o� an
authorized orqanization acting on behalf of the organizalion and has been
issued a license by the Sheriff's Department.

1. Ppnlications for license shall be made to the Sheri`f' s License Divi;ion,, '
� 222- ldest "C" Street, San Dieco, on forms precrihed hy the .`;hcri`f, an;i
shall be filed not less than thirty (30) days prior to the proposed da[e
of the games.
2. The application form shall reouire (rom the ��pplicant at lea;t the
follo��ina information:
(a) A list of all members t•�ho mill operate [he binco qames , including
full nanies of each member, date and place of birth, phy;ical
description, and driver's license number.
(b) Tne dates and places of the proposed binno 9ames.
(c) Proof that the organization is an authorized orpanization as
defined by the ordinance:
1) _Oraanizations that nualify under speci`ied sec�ions of
23701 of the F.evenue and Taxation Code must w bmit a copy
of tfieir letter of tax exempt status from the Franchise
Tax fioard. For information vou may call 237-7540.
2) P�obile Home Park and Senior Citizen Associations must
submit mritten proof in the form of a copy of the
association's b.y-laws or other similar riritten evidence.

1. The term of a bingo license is for one year from the date of issue.
2. The fee for a bin90 license is 550. An additional fee of ]" of the mon*_hly
gross receipts over 55,000 derived from binqo 9ames shall be collected
nonthly by the Sheriff.
3. If after the license has been issued the organization submits additional
names to the Sheriff for approval , the application for approval shall be
accompanied by a fee of five dollars (5.00) for each nanie.
4. Each license issued shall be issued to a snecific oerson on behalf of a
specific organization to conduct bingo at a specific location and shall
not be transferable from one person to anothe r nor from one location to
another.
5. An authorized orqanization shall conduct bin90 only on propertyo u�•:ned or
leased by it, and emich prop�rty is used Ly such ornani;ation for an o`f�ce
or fOr the performance of the purposns for �,�hich Lhe w-?arizatien is
organized. '
