BACKGROUND ' SECOND RF�+DI\G AND ADOP_TION 1 . On September 13, 1979 the City Council unanimously accepted the Clty Manager' s recormnendation to delegate to the Design Review Cortrtnittee the responsibility for reviewing coimnercial and industrial developments in cases where the "P" Modifying District is attached to the underlying zone. . 2. The actions recortmended in this report are designed to implement the charge of Council without reducing the effectiveness of the provisions of the "P" Modifying District. 3. The Environmental Review Coordinator conducted an Initial Study, IS-80-24, on the proposed amendments to the Chula Vista Municipal Code and Design Manual addendum, and on November 2, 1979 issued the attached draft Negative Declaration. � B. RECOhQ'4ENDATION 1 . Find that in accordance with the draft Negative Declaration on IS-80-24 and the findings therein, the proposed zoning text amendments and design manual addendum will not have a significant impact upon the environment and adopt the Negative Declaration. 2. Adopt the ordinance as recormnended by Resolution PCA-80-1 designating the Design Review Committee as the agency responsible for reviewing developments in the cortunercial and industrial zones when the "P" hbdifying District is also attached. 3. Adopt the proposed "Commercial Principles Addendum" (see Exhibit A) to the Design Manual of the City of Chula Vista. ANALYSIS 1 . Under the proposed zoning text amendments, the site plan and architectural review of corrmercial and industrial projects governed by the "P" Modifying District would be placed within the purview of the Design Review Cortmittee. This Cortenittee's present jurisdiction is confined to multiple-family residential projects. 2. The proposed extension of the Design Review Comnittee's jurisdiction would simplify the precise plan review of commercial and industrial projects by reducing the number of reviewing bodies, and should resultantly reduce private processing and project development costs. This extension would also relieve the Planning Comnission and City Council of the burden of devoting much time to matters which are technical in nature, and which are not of great significance from the standpoint of city planning policy. 3. The proposed "Comnercial Principles Addendum" to the Design Manual , if adopted, would provide the committee guidelines, criteria, and standards upon which it could base its decisions. Any proposed amendments, modifications, or refinements to the Addendum would necessitate prior action by the Planning Comnission and City Council . 4. Since industrial uses tend to be more individualized than residential or cortmercial pro,�ects, standardized design principles cannot be readily applied to them. Industrial uses, therefore, must be addressed, from the standpoint of urban design, on a case-by-case basis. 5. BACKGRCUND On Nover�ber 1, 1977 the City Council established the Design Review Comnittee � which was charged with the duty of reviewing all proposed multiple family or condominium develo�nents. Later its jurisdiction was expanded to include condaninium conversions. In addition, the Council adopted the Design Review Manual which provides principles and guidelines for multiple family and condaninium developments. The City Council recently directed the Planning Department to prepare a proposed zoning text amendment to expand the jurisdiction of the Design Review Comnittee, to include the review of cortmercial and industrial projects located within the P Precise Plan Modifying District and to appropriate changes to the Design Manual . The provosed anendment to the Chula Vista Municipal Code and addendum to the Design Review Planual is designed to promote the expeditious processing of camnercial and industrial projects governed by the P Modifying Dist�rict regulatians, without reducing the effectiveness of the provisions of the P Modifying District. B. PROJECT DESCRIPTION 1. The follo��iing amendments to Title 19 of the Piunicipal Code are proposed: Chapter 19.56 MODIFYING DISTRICTS Section 19.56.048 P Precise Plan Modifying District -- Plan Review of �rultiple Family Dwelling, Comnercial , or Industrial Pro�ect Notwithstanding the provisions of Section 19.56.047, plans .for multiple-family dwelling, corranercial , or industrial projects in areas governed by the Precise Plan Modifying District shall be reviewed by the Design Review Cor.r•iittee, and shall be considered by the Planning Connnission and the City Council only upon appeal , pursuant to Section 19.14.583. Chapter 19.14 A�4INIST4ATIVE PROCEGURES, CONDITIOdaL USES, VARIANCES Section 19.14.579 Precise Plan Approval--Multiple Family Dwelling, Camnercial , or Industrial PPOjects ' • r hJot�+'rthstarding the provisions of other sections of this chapter, the 'revie4i of precise plans for multiple-family dsaelling, corrxnercial , or industrial �rojects shall be proceaurally governed by the rules adopted by the Design ,Revietv Committee, created under Section 19.14.581. Section 19. 14.580 Precise Plan F.pproval for Multiple-Family, Cor.imercial , or Industrial Projects--Zoning Administrator Folloi,ring the approval or ccnditional approval of a precise plan for a nultiple- fanily d�•relling, conmercial , or industrial project by the Design Review Cor�nittee, or, upon appeal , the Planning Cortvaission or City Council , the Zoning Administrator shall issue a zoning permit as provided in Sections 19.14.500 through 19.14.550 , of this title, and the building insoector shall ensure that the development is undertaken and conpleted in conformance with the approved plan. 2. An addendum to the Design Review Manual is oroposed addressing the "Principles and Standards" of development for neighborhood and subneighborhood shopping centers and general corr,iercial projects and centers. � C. COt•iPATiBILITY !•JITH ZONI:'JG AND PLANS The pronosed ZTA is not inconsistent with the Chula Vista Zoning Ordinance and is not at variance tivith the General Plan or associated elements. D. IDEPlTIFICATION CF ENVIROF:t•tENTAL EFFECTS � SOCIAL This ZTA alill eliminate the process of notifyina property owners within 300 ft. of a proposed project and advertising, through the local newspaper, the time and location of a public hearing befare both the Planning Comnission and the City Council for projects located within the P 11odifying District. Public input into th� merits of a particular precise plan will be curtailed by adoption of these a^�endments. Site plan and architectural revie�a through the Precise Plan process is of a technical nature, therefore members of the Design Review Coronittee have been selected for their expertise in a technical field and shall provide a more objective and experienced analysis of a propcsed project. Public review of a project, throu9h a Planning Commission public hearing, shall be assured if the potential for adverse environmental effects is found to be present through the environmental review process. E. FIfJDINGS OF IPJSIGNIFICANT IPIPACT 1. Th? project is not site specific, therefore viill not adversely affect any natural or man-nade resource. 2. Proposed arrendments are consistent with the intent of the General Plan and asseciated elements and are not anticipated to achieve short tern to the disadvantage of long *_ertn environmental goals. 3. No impacts are anticipated to occur, due to project implementation, which could interact to create a cumulative adverse effect an the environment. � . ' �4. NO:J, THEREFORE, BE IT RESOLVED AS FOLLCWS: 1 . From the facts presented to the Planning Cortmission, the Corrmission finds that public necessity, convenience, aeneral 4:elfare and good zoning practice require that Sections 19. 14.579, 19.14.580, 19.14. 582 and 19.56.048 be amended to read as follows: � 19.14.579 Precise plan approval--Nultiple-family dwelling, cor.unercial , or industrial projects Notwitnstanding the provisions of other sections of this chapter, the revie�v of precise plans for multiple family dwelling, cortmercial , or indus- trial projects shall be procedurally governed by the rules adopted by the Design Review Committee, created under Section 19.14.581 . 19.14.580 Precise plan appruval for multiple-family comrfercial , or industrial projects--Zoning administrator. Following the approval or conditional approval of a precise plan for a rt:ultiple family dwelling, co�nercial , or industrial project by the Design Review Cortmittee, or, upon appeal , the Plannina Comnission or City Council , the Zoning Adr�inistrator shall issue a zoning permit as provided in Sections r 19. 14.500 through 19. 14.550 of this title, and the building inspector shall ensure that the development is undertaken and cor�pleted in conformance with the approved plan. 19. 14.582 Design review coirnittee--Duties • and responsibilities. A. The design review cor.mittee shall reviev� plans for the establishment, location, expansion or alteration of residential uses or structures in the R-3 zone, and multiple-family dwelling uses, comnercial , or industrial projects or structures governed by thP P precise plan modifying district; and shall approve, conditionally approve or deny � such plans. 19.56.048 P Precise plan modifying district--Plan review of multiple-fanily do-:elling, cortmercial , or industrial project Notwithstanding the provisions of Section 19.56.047, plans for• multiple- family dwelling, cormnercial , or industrial projects in areas governed by the P precise plan modifying Qistrict shall be reviewed by the design review comnittee, and shall be considered by the planning cortmission and the city council only upon appeal , pursuant to Section 19. 14.583. 2. The Planning Cortmission reco�nends to the City Council that said amend- ments be adopted. 3. That this resolution be transmitted to the City Council .
