On November 13, 1979 the City Council adopted an interim ordinance (Ordinance 1882) allowing plant nurseries and the sale of related hardware items in the C-0 (Admin- istrative and Professional Office) zone subject to the approval of a conditional use permit. The ordinance will remain in effect for a period of ninety days and the purpose of this item is to permanently establish what has been adopted on an interim basis. 2. On December 12, 1979 the Planning Commission adopted the Negative Declaration on IS-80-30 which is herewith forwarded to the City Council for consideration. B. ANALYSIS The present regulations of the C-0 zone allow a limited number of retail uses subject to a conditional use permit, provided they offer a service .to the occupants of the business district and do not disrupt the continuity of the office uses. The City Council , by its action on November 13, 1979 determined that plant nurseries and the sale of related hardware items should also be included as uses allowed by conditional use permit. The purpose of this proposed ordinance is to permanently establish what has been adopted on an interim basis. The conditional use permit procedure will provide a review process which will help insure the appropriateness of plant nurseries at a particular location and the attachment of conditions which would prevent adverse -effects on adjoining properties. PROJECT PROPOSAL The following amend�nents to Title 19 of the hiur,icipal Code including ar�ending Section 19.30.940 by adding a new subsection "H" thereto and redesignating subs2ction "H" to subsection "I" as follows: Section 19.30.040 Conditional uses. H. Plant nurseries and sale of related hardware items. I. Unclassified uses, see Chapter 19.54. C. COt•1PATIBILITY :JITH ZONING AND PLANS The proposed amendment is not consistent with the designated purpose of Section 19.30.010 of the Chula Vista Municipal Code. This section of the Zoning Ordinance reads: "The purpose of the C-0 zone is to provide appropriate locations where pro- fessional and administrative office zones may be established, maintained and protected. The rec7ulations of this district are designed to promote a quiet and dignified environment for business administration, professional and government activities, free from the congestion and traffic of the usual retail business district. To this end, the regulations permit office buildings and medical and financial facilities; appropriate corrunercial facilities primarily for the service of the occupants of the district are oermitted subject to special controls. The intensity of development of such a district is intended to reflect its environmental setting o-�ith building height and coverage generally similar to and harmonious �vith those of neighboring districts. ��0�� - D. Fii:DiilGS OF S?Gi;IFIC�iJT Ii�iPACT As pr000scd', the 'amendment has the potential of long-term impacts �ontrary to the puroose uT the !•lunicipal Code. The potential for iuture retaii nursPries ':o�a[ing within areas designated for cort�nercial and administrative offices will exist unless specific locational quidelines are incorporated into the Code. � E. MITIGATI0�1 1 . Guidelines should be incorporated into the Plunicipal Code which �•:ould designate the allo+•�able locations for retail plant nurseries as being oerioiieral to arzas of the C-0 zone so as not �o disturb the character of the protessional and adminis- � trative oTTice iand uses. 2. The sale of related hardware items shall be clearly "incidental sales" and secondary to the olant nursery. F. FIilDIilGS OF IivSIGiJIFICANT Ih1PACT 1. The proposed ordinance is not site specific, therefore will not adversely affect any natural or man-made resources. Each site o-+ill be subject to further revie�a through the Conditional Use Permit process. 2. The oroject pr000sal �•�ill not achieve short-term to the disadvantage of long- term environmental aoals provided that proposed mitigation is incorporated in�o the Zoning Ortlinance. 3. Tne project is not anticipated to result in any adverse imoacis o-�hich could interact to create a substantial cumulative effect on the environmen�. 4. iJo sianificant increase in vehicle traffic or related noise or emissions is expected to occur due to project implementation. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1 . From facts presented to the Planning Coronission, the Cormnission finds that public necessity, convenience, general welfare and good zoning praci:�ice require the enactment of the following amendment to Section 19.30.040, aci�ing a new subsection H thereto and redesignating subsection F: to subsection I , to read as follows: H. Plant nurseries and the sale of related hardware items, provided they are clearly incidental and secondary to the plant nursery. Plant nurseries shall be allowed only on the peripheral areas of the C-0 zone, so as not to disrupt the continuity of the profes- sional and administrative office land uses. I. Unclassified uses, see Chapter 19.54. 2. The Planning Commission recomr.iends to the City Council that said amendment be adopted. 3. Ttao parcels located at Third Avenue extension and Sea Vale suitable to Ms Klindt are now being aquired for a business site for relocation. We therfore ask the council to adopt an urgency ordinance amending the C-0 district regulations to list "Nurseries and Sale of Related Hardware Items" as conditional uses in the C-0 zone , so that we may apply for a conditional use permit to relocate the Peters Home and Garden Center to Third Avenue extension and Sea Vale.
