BACKGROUND
1 . On August 14, 1979 the City Council voted 3-1 , with one member absent, declaring
their intent to prezone the 3.00 acres at the corner to C-C-P and the remaining 15+
acres to R-3-P-8.
2. As required by city code the matter was referred to the Planning Comnission
- for a report prior to adoption of the ordinance by the City Council . On August 22nd
the Cortunission voted 3:2 to recorronend that the subject property be rezoned to C-C-P
and R-3-P=8. This reversad of position was based on the Corrunission 's feeling that the
zoning should be brought into conformance with the General Plan.

4lHEREAS, a duly verified application for rezoning was filed with the
Planning Department by Architect Paul Thoryk, A. I.A. & Associates, acting as
agent for ADidA Company, Inc. , on June 8, 1979, application No. PCZ-79-J, and
WHEREAS, said application requested the change of prezoning f,�om A-8 to
R-3-P-8 for 15.14 acres and to C-C-P for 3.00 acres located at the southeast
corner of Bonita Road and Otay Lakes Road, and
41HEREAS, the environmental impact report, EIR-79-7, on the project o-ias
certified by the Planning Comnission on April 18, 1979, and
WHEREAS, following a duly advertised public hearing held on July 11 , 1979
the City Planning Comnission recomnended to the City Council the change of
prezoning from A-8 to R-3-P-8 for 18.14 acres, and
41HEREAS, follooiing a public hearing held on August 14, 1979, the City
Council affirmed its intent to prezone 3.00 acres to C-C-P and 15. 14 acres to
R-3-P-8 and referred the application back to the Planning Cor,mission for report
and recomnendation, and
4lHEREAS, the Planning Comnission reconsidered the request for change of
prezoning at a public meeting held on August 22, 1979.
P�ObI, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1 . From facts presented to the Comnission, the Comnission finds that public
necessity, convenience, general welfare and good zoning practice require the
change of prezoning from A-8 to C-C-P for 3.00 acres and to R-3-P-8 for 15.14
acres located at the sou;:heast corner of Bonita Road and Otay Lakes Road, subject
to the following precise plan guidelines:
a. The Comnercial area shall be architecturally coordinated through
the use of sinilar materials, colors and architectural style, in
keeping with the rural characteristic of Bonita.
b. Freestanding signs shall be restricted to monument signs.
c. The Comnercial lot shall not be divided into separate parcels until
such time as an overall site plan and elevations (architectural ther�e)
are approved for the entire three acres.
d. The residential development shall be designed into small cluster and/or
duplex structures khich will fit with the terrain by utilizing split
level designs to minimize topographic changes in elevation.
e. Residential parking areas shall be interspersed throughout the
project to insure their distribution and to avoid the creation of
large parking areas.
f. The entire project shall emphasize the use of mounding, landscaping,
and textured paving to enhance the design.
g. No building shall be closer than 25 feet and no parking area cluse�•
than 15 feet to the ultimate sideo-�alk location along either Bonita
Road or Otay Lakes Road.
2. The findings of fact in support of said determination.are as follows :
a: The R-3-P-8 zone will enable the property to be developed at a
• density which will encourage clusterina of structures and preservation
of the integrity of the topographic features of the site. �
b. The C-C-P zone will provide additional opportunity for zxpanding
retail sales in an area vlhich is experiencing rapid grovith. �
3. Findings for application of the "P" t4odifying District are as follows:
a. The subject property, or the neighborhood area in which the property
is located, is unique by virtue of topography, geological characteristics, access,
configuration, traffic circulztion, or some social or historic situation requiring
special handling of the development on a precise plan basis.
The two streets abutting the subject property are designated as
� scenic routes, requiring compliance with the "Scenic Routes Policy"
through the precise plan procedure. The topographic character of
the area also justifies the use of the "P" �todifying District so
the precise plan can demonstrate how the grading and siting of
units will be handled.
b. The basic or underlying zone regulations do not allow the property
owner and/or the city appropriate control or flexibility needed to achieve an
efficient and proper relationship among the uses allo�aed in the adjacent zones.
The attachment of the "P" t4odifying District will enable the City to
insure compliance with the Scenic Routes Element of the General Plan.
c. The area to which the "P" �•todifying District is applied consists of
t��� or more properties under separate o4mership wherein coordination regarding
access, onsite circulation, site planning, building design and identification is
necessary to enhance the public convenience, health, safety and general welfare.
The attachment of the "P" Modifying District will insure that the

4. The Planning Commission recommends to the City Council that said change
of prezoning from A-8 to C-C-P for 3.00 acres and to R-3-P-8 for 15.14 acres
located at the southeast corner of Bonita Road and Otay Lakes Road be approved.
5. That this resolution be transmitted to the City Council and a copy
transmitted to the applicant.
