HomeMy WebLinkAboutReso 1992-16460 RESOLUTION 16460 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING MITIGATED NEGATIVE DECLARATION IS-92-14 AND ISSUING COASTAL DEVELOPMENT PERMIT #55 FOR THE CONSTRUCTION OF THE FULL WIDTH OF LAGOON DRIVE ADJACENT TO 850 LAGOON DRIVE. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista Local Coastal Program (LCP has been certified by the California Coastal Commission; and, WHEREAS, said LCP includes Coastal Development procedures determined by the Commission to be legally adequate for the issuance of Coastal Development Permits and the City of Chula Vista has assumed permit authority of the Chula Vista Coastal Zone; and, WHEREAS, a public hearing was duly noticed and conducted on January 7, 1992, in accordance with said procedures; and, WHEREAS, the City Council of the City of Chula Vista, as "approving authority", has reviewed the proposed construction of full width improvements of Lagoon Drive adjacent to 850 Lagoon Drive. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: A. The City Council has reviewed the Initial Study and any comments thereon and hereby adopts Mitigated Negative Declaration IS-92-14 on file in the City Clerk's office; and, B. The City Council of the City of Chula Vista finds, based on the following findings, that the proposed public improvements, subject to the conditions listed in Exhibit A, is consistent with the intent of the policies of the certified Chula Vista Local Coastal Program: 1. According to Mitigated Negative Declaration IS-92-14, the proposed improvements will minimally intrude into the wetlands north and south of the roadway, and will not change water movements. The roadway improvements include drainage outlets to be approved by the City Engineer. Non-point source runoff will occur, however, the drainage will not discharge into the adjacent wetlands. Instead, it will drain into a triple chamber water quality control structure, through the proposed drainage system, and into the detention basin on the adjacent Rohr office complex, and eventually to the San Diego Bay. Therefore, no impact on the adjacent wetlands will result because of project drainage. Resolution No. 16460 Page 2 2. Lagoon Drive is a street right-of-way within the Chula Vista Bayfront. Improvement of the street by widening and resurfacing will provide an incremental increase in improved access to the San Diego Bay and coastal resources. 3. The project is part of the overall Bayfront circulation system and has been designed in conformance with the prototypical street improvement section for Lagoon Drive as set forth in the certified Chula Vista Local Coastal Program. 4. The project is located adjacent to the Sweetwater Marsh National Wildlife Refuge and a seasonal wetland. Project grading will minimally intrude into both areas. Mitigated Negative Declaration 15-g2-14 indicates that biological resources will not significantly effect by grading. In addition, in their letter of permission to Rohr Industries to allow off-site grading, the U.S. Fish & Wildlife Service has indicated that the minor grading in the project area as proposed, subject to conditions will not impact wetlands. Therefore no adverse effect on wetlands is anticipated as a result of grading in accordance with the proposed plans. BE IT FURTHER RESOLVED that the City Council hereby approves Coastal Development Permit No. 55. Chris'%alomone Bruce M. Boo!~a~rd Community Development Di rector City Attorney Resolution No. 16460 Page 3 EXHIBIT A LAGOON DRIVE STREET IMPROVEMENTS CDP J55 CONDITIONS OF APPROVAL 1. Before Coastal Development Permit #55 is considered valid, the following items must be completed to the satisfaction of the Chula Vista City Engineer: a. A Hold Harmless Agreement with the City of Chul a Vista to accept pulblic storm water. b. Street dedication and storm drain easements must be dedicated to the City of Chula Vista from Rohr Industries and Chula Vista Investors or their successors in interest. c. Dedication of appropriate sewer and utility easements to the City of '- Chula Vista, utility companies and other appropriate Agency. d. Address plan check comments (third check). e. Add one sheet to project plans with details of connection to metropolitan sewer line and flume curve for the metering station. f. Add the City of San Diego Title Block and obtain appropriate signatures. g. Obtain appropriate water authority signatures. h. Provide letters of permission (3) for offsite grading. 2. Restrictions on noise from noise intensive construction activities must occur between March 15 and September 15, in accordance with Mitigated Negative Declaration IS-92-14. 3. A note shall be placed on grading and improvement plans stating that the project shall comply with grading and drainage requirements set forth in section 19.87.07 of the Chula Vista Local Coastal Program Bayfront Specific plan. 4. Plans shall be in conformance with prototypical cross section E, figure 4, Lagoon Drive with bike lane as set forth in the Chula Vista Local Coastal -- Program, Specific Plan (amended 4/89). Resolution No. 16460 Page 4 5. Applicant shall obtain a Right of Entry Permit from MTDB to allow vehicle traffic within the added street width located in the MTDB R/W. I, ~ ~, 0-~ LL , authorized representative for Rohr Industries, have read and understand these conditions of approval as required by the Chula Vista City Council as they pertain to the construction of full width street improvements adjacent to 850 Lagoon Drive and agree that the above conditions of approval be incorporated into Coastal Development Permit #55.
