HomeMy WebLinkAboutReso 1990-15659 RESOLUTION NO. 15659 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR SUN-UP VISTA, CHULA VISTA TRACT 89-12 - GOLD KEY DEVELOPMENT The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Gold Key Development has submitted a tentative subdivision map known as Sun-Up Vista, Chula Vista Tract 89-12, proposing to subdivide 2.31 acres located on the south side of Telegraph Canyon Road, east of Hilltop Drive, into 8 single family lots, including an existing house at 66 Telegraph Canyon Road, and WHEREAS, the Environmental Review Coordinator conducted an Initial Study, IS-89-74, of potential environmental impacts associated with the implementation of the project and based on the attached Initial Study and comments thereon, if any, the Coordinator has concluded that there would be no significant environmental impacts, and recommends adoption of the Negative Declaration issued on IS-89-74, and WHEREAS, this item was continued from the meeting of October 17 and December 12, 1989 and January 16, 1990 in order to allow the applicant to reevaluate the proposal with respect to several concerns raised at the hearing involving development in the panhandle area, lot size/FAR's, driveway access onto Telegraph Canyon Road, wildlife and soils/drainage, and WHEREAS, on September 13, 1989, the Commission voted 5-1-1 to recommend that Council approve the map in accordance with the findings and conditions in Resolution PCS-89-12. NOW, THEREFORE, that the City Council does hereby find, determine, resolve and order as follows: Section 1. The City Council concurs in the determination of the Environmental Review Coordinator, who conducted the aforementioned Initial Study, IS-89-74, that there would be no significant environmental impacts by the approval of the tentative subdivision map, and does hereby adopt as its own, the negative declaration issued on IS-89-74. Section 2. The City Council does hereby make the following findings: 1. The site is physically suitable for residential development and the proposal conforms to all standards established by the City for such projects. Resolution No. 15659 Page 2 2. The design of the subdivision will not affect the existing improvements -- streets, sewers, etc. -- which have been designed to avoid any serious problems. 3. The project is in substantial conformance with the Chula Vista General Plan Elements as follows: a. Land Use - The proposal as conditioned is consistent with the General Plan designation of Low-Medium Residential (3-6 du/ac), and General Plan policies related to grading and landform. b. Circulation Telegraph Canyon Road and the private drive shall be improved in accordance with City Standards. The reduction of one lot in the panhandle area will improve circulation for those lots. c. Housing - The project shall provide single family, detached housing consistent with that in the immediate area. d. Conservation The biologic component of the site is not unique and does not contain threatened or endangered species. There are no significant impacts with regard to wildlife habitat, soils or ground water. e. Park and Recreation, Open Space The project shall be required to pay park acquisition and development fees prior to approval of a final map. f. Seismic Safety - No faults or landslides are known to exist on the project site. the La Nacion Fault Zone, located approximately 800 feet west of the property, has little potential as a source for a damaging earthquake. g. Safety - The project site is within threshold standards for both police and fire protection. the panhandle dwellings will be equipped with indoor sprinkler systems in lieu of adequate access for fire equipment. h. Noise - The site is not subject to adverse noise impacts. i. Scenic Highway - The property does not adjoin a scenic route or gateway. j.Bicycle Routes The property does not adjoin a designated bike route. k. Public Buildings - The project is subject to the payment of school impact fees prior to the issuance of building permits. Resolution No. 15659 Page 3 4. Pursuant to Section 66412.3 of the Subdivision Map Act, the Council certifies that it has considered the effect of this approval on the housing needs of the region and has balanced those needs against the public service needs of the residents of the City and the available fiscal and environmental resources. 5. The general orientation of the dwellings is conducive to passive and natural heating opportunities. The wide sideyards will allow for natural cooling to a greater extent than typically found. Section 3. Subject to the enumerated conditions set forth hereinbelow, the City Council does hereby approve the tentative subdivision map for Sun-Up Vista, Chula Vista Tract 89-12: 1. That lot identified on the Revised Tentative Map as Lot #1, a parcel of property containing approximately 23,594 square feet and which Lot #1 is located south of the flood control channel shall be combined with that lot identified on the Revised Tentative Map as Lot #2, a lot consisting of 9,622 square feet to form a single lot and which shall hereinafter be referred to as "Consolidated Lot". Property owner shall, prior to the recording of the final map, convey for the benefit of the City, an easement for "Open Space Purposes" over that portion of the Consolidated Lot identified on the Revised Tentative Map as Lot #1, a lot consisting of approximately 2357 square feet. As the term is used herein, "Open Space Purposes" shall mean that improvement of said lot is prohibited except for landscaping, incidental gardening structures, or grading and grubbing as shall have received the advanced review, approval and written permission of the City by and through its Zoning Administrator, without the express written permission of the City. It is the intent of this condition that the area designated "for Open Space Purposes" be retained as a natural-appearing open space area. 2. The open space portion of "Consolidated Lot" as defined in Condition No. 1 shall be maintained by the owner of that lot. Maintenance, as the term is herein used, shall include keeping the area free of trash, debris or foreign matter and free from fire hazards such as excessive growth of brush. Applicants shall record a restrictive covenant on the face of the final map which will obligate the fee owner to maintain the area for the benefit of the City in such form as meets with the approval of the City and which shall provide for the implementation of this condition, and which will further provide that in the event the property owner shall fail to maintain said area, that the City of Chula Vista or their designee may enter upon, and maintain said open space area, the cost of which will be borne by the property owner. The property owner shall grant to the City of Chula Vista a lien against the property for the purpose of securing the recovery of the cost of such maintenance. 3. The dwellings shall be resited and/or the floor plans or lot lines adjusted in order to provide adequate, usable yard space for each lot subject to staff review and approval. Sideyards meeting this Resolution No. 15659 Page 4 requirement shall have a minimum dimension of 15 feet. CC&R's shall be recorded, with the City being a party thereto, prohibiting future building construction within the 15 foot sideyard. Said construction may exclude patios with an open trellis design approved by the City. 4. All floor elevations shall be elevated to a minimum of one foot above the designated flood elevation as shown on the Flood Insurance Rate Maps issued by the Federal Emergency Management Agency {FEMA). The developer may submit a request to FEMA for a Letter of Map Amendment or Revision (LOMA or LOMR) to prevent future owners from paying flood insurance premiums. The developer shall pay all costs and fees associated with obtaining such a letter. 5. The approval of a final map by the City Council will require compliance with the City's adopted threshold standards to the satisfaction of the Director of Planning. 6. The developer shall be responsible for the construction of street improvements in Telegraph Canyon Road as shown on the Tentative Map. Said improvements shall include, but not be limited to, asphalt pavement and base, concrete curb, gutter and sidewalk, street lights, sanitary sewer, fire hydrants and portable water facilities. Required improvements shall be installed along the entire subdivision frontage and shall extend to the existing concrete curb easterly of the property. 7. The development shall dedicate to the City additional right-of-way along the south side of Telegraph Canyon Road adjacent to the subdivision as shown on the Tentative Subdivision Map. 8. The developer shall provide a concrete low flow channel in the tributary water course at the rear of Lot 2 unless the City Engineer determines that such a channel is not necessary. A drainage study shall be submitted to demonstrate the adequacy of the channel and to demonstrate that the channel is compatible with upstream improvements. 9. Side slopes in the major drainage channel shall be no steeper than 2:1 (horizontal to vertical ratio) unless approved by the City Engineer. 10. Access shall be provided to all storm drain structures including low flow channels adjacent to back of lots. The form and type of access is to be approved by the City Engineer. 11. The property owner shall grant an easement to the City to provide for maintenance of the major Telegraph Canyon Channel. Said easement shall be granted on the Final Subdivision Map. Resolution No. 15659 Page 5 12. Specific methods of handling storm drainage are subject to detailed approval by the City Engineer at the time of submission of improvement and grading plans. Design shall be accomplished on the basis of the requirements of the Subdivision Manual and the Grading Ordinance (No. 1797 as amended). 13. The developer shall obtain notarized 1 etters of permission for all off-site grading work prior to issuance of grading permit for work requiring said off-site grading. 14. The developer shall grant to the City a street tree planting and maintenance easement along Telegraph Canyon Road. Said easement shall extend from the property line to a line lO feet from the back of the sidewalk. 15. The developer shall provide access on an equal basis to and upon individual lots for all franchised cable television companies. 16. The developer shall provide barriers on the portion of the existing, exposed sewer line crossing the property subject to review and approval of the Director of Public Works. 17. The following statement shall be placed on the Final Map: "Please be advised that the City of Chula Vista intends to adopt a Growth Management Element, Transportation Phasing Program, and other related growth management implementation programs, which may regulate the location and timing of development in the City,. The City intends that development of property included in the Final-Map will be subject to the provisions of these programs. Owners listed on this map shall be responsible for providing notification to any purchaser or successor in interest to any portion of this property of the City's intent in this regard." 18. The drainage channel on the rear portions of the lots which are the subject matter of this subdivision map shall be maintained by the property owners on whose property the drainage channel is 1 ocated. Maintenance, as the term is herein used, shall include the repair and maintenance of the structural integrity of the channel as well as keeping the channel free of trash, debris or foreign matter which would inhibit or otherwise restrict the flow of water. Applicants shall record a restrictive covenant on the face of the final map which will obligate the fee owner to maintain the drainage channel for the benefit of the City in such form as meets with the approval of the City and which shall provide for the implementation of this condition, and which will further provide that i n the event property owners shall fail to maintain said drainage channel, that the City of Chula Vista or their designee may enter upon, and repair and maintain said channel, the cost of which will be borne by the property owners. The property owners shall grant to the City of Chul a Vista a lien against the property for the purpose of securing the recovery of the cost of such maintenance. Resolution No. 15659 Page 6 19. Property owner shall covenant not to construct or improve, in a form satisfactory to City, that portion of the property on which is located a drainage channel to the level thereof which the City Engineer determines would be needed to accommodate water removal during a 100 year flood condition. 20.
