HomeMy WebLinkAboutReso 1947-846 i S RESOLUTION O. 846 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING- AND ACCEPT- ING THAT' CERTAIN PROPOSAL BY 3ALIFORNIA WATER AND TELEDHONE COMPANY,DATED NOVEMBER 21st,. 1947,, AND APPOINTING THE SAID CALIF- ORNIA.WATER & TELEPHONE COMPANY THE AGENT OF THE SAID CITY-FOR THE"'PURPOSES SPECIFIED '` . . IN SAID PROPOSAL. THE CITY COUNCIL OF THE CITY OF ,CHULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: That certain proposal by CALIFORNIA WATER & TELEPHONE COMPANY,, dated November 21st, 1947,,' a copy of which is attached hero,, marked to Exhibit A" and made a part hereof the same as if fully set out herein,, be and the same is hereby approved and accepted, and the said CALIFORNIA WATER & TELEPHONE COMPANY is hereby appoint- ed the agent of the said City to accept and distribute Colorado River Water from the SAN DIEGO COUNTY WATER AUTHORITY under the terms and conditions of the said proposal. • ADOPTED, SIGNED AND APPROVED this 25thday of November, 1947. I EXHIBIT "A" November 21, 1947 To the Honorables: E ' The City Council of the City of Chula Vista, The City- Council ofthe City of National City, Gentlemen: For the past few days we have been in negotiations with your respective City,. Attorneys and appointed committees toward the end of a contract under which our company will be empowered to distribute, through its system, water which your cities are entitled to purchase as agencies of the San Diego County Water Authority.. A tentative draft of the agreement has been prepared for consideration by your respective councils and our board of directors. Ho*ever, it ,appears unlikely that final consumation of the agreement can be accomplished prior to the titre that water becomes available for distribution. Accordingly, and particularly in view of the existing situation as to our water . supply,, we suggest and hereby propose a temporary arrangement,, to become effective upon approval thereof by duly adopted reso- lutions of your respective councils and to continue in effect until merged in a permanent contract or terminated by written notice given either by us or by your councils jointly... The terms of the proposed temporary arrangement areas follows: (1) Our company shall be empowered to distribute, through our facilities, for domestic, 'municipal and other beneficial uses, within the areas pe,missable under the rights held by your cities as agencies -Of the San Diego County Water Authority,, such water as your cities shall be entitled to purchase from said Water Authority and which our company may require for the purposes aforesaid. (2) Such water shall be delivered through the distribution system of the City- of San Diego pursuant to the, license therefor heretofor granted by said city to the San Dieg9' County Mater Authority,, and conditioned upon the -continuance of said license. (3) We shall pay all costs and charges- imposed 'by the City of San Diego for transporting said water through its distribution system, and also any, costs or expenses involved in making, connections between our distribution system and that of the City of San Diego. (4) We shall pay for all water delivered for distribution pursuant hereto at the rate duly established therefor by the San Diego County Water Authority, such. payments to be made promptly upon billing.. Inasmuch as Colorado River water is likely to be avail- able early in December, we would appreciate it if action could be taken upon this proposal at your next council meetings, and that we be advised promptly with reference thereto so that we may pro- ceed with such preparations as may be necessary. may we also suggest that it would be to the common interests of your cities and our company that action upon the permanent contract be taken . at the earliest possible date.
