HomeMy WebLinkAboutReso 1947-795 4 . RESOLUTION NO. 795 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, AUTHORIZING CONTRACT ' :WITH WILLIAM T. WRIGHT. ' ` WHEREAS, this City Council intends to submit to the voters of the City of Chula Vista a proposition to issue bonds of said city for the purpose of recon- structing and making additions to the treatment plant of the city and •for the ,construction of additional main trunk sewer lines and interceptor sewer lines; and WHEREAS, a contract for the employment of William T. Wright, a registered civil engineer, to do the engineering work upon said project has been presented to this City Council and examined; NOW, THEREFORE, ' the City Council, of the City of Chula Vista, California, DOES HEREBY RESOLVE, DETERMINE • • AND ORDER as follo•Uvs Section_ 1. April 30, 1949 The Chula Vista sewage treatment plant is designed to treat the raw sewage by sedimentation, oxidation and diges- tion, The plant is composed of a control house, primary and secondary oxidators , a heat controlled digester, grit chambers, gas collection equipment, heat exchanger, and the necessary pumps, motors and controls for the operation of the plant. A unique feature of this plant is the oxidators. While the process of oxidation of sewage is not new; these oxidator units combine aeration and sedimentation in one unit which is new, Previously, aeration units and clari- fying or sedimentation units were built separately and con- nected by a suitable pipe system, Combining these two into one unit makes Considerable saving in construction costs and simplifies operation. • The oxidators provide for the processes of sedimen- tation and oxidation, A predetermined amount of air is cir- culated through the inner or aeration chamber by blowers. This circulating air provides a continuous supply of oxygen -1- .)-J for oxidation purposes. The outer area or chamber of the oxidator is quiet and provides for settling both organic and inorganic matter. This settled matter is known as sludge and is transferred from the oxidators to the digester by sludge pumps, The digester has a floating cover which oollects all gases generated in the digester, These gases have char- acteristics quite s1'ilar to commercial gas and are used as fuel about the plant; the excess as being burned by a waste gas burner. The digester operates best at about 90 degrees and a heat exchanger for controlling the temper- ature of the sludge in the digester is. provided. The heat exchanger is heated by gas m the -digester. The final digested sludge is delivered to sludge dry- ing beds where it is permitted to dry. The dried sludge may be used as fill material. It also has considerable value as fertiliser. The final effluent or liquid which is delivered to the bay comes from the oxida tors. Before it is finally dis posed of it is autooatically. chlorinated to eliminate any possible disease bearing germs and to prevent any contamin- ation of bay waters* Practically all sewage treatment processes depend upon bacteria to reduce the organic matter in sewage. These bac- teria are of many types, and are quite sensitive to the con- ditions under which they exist, Different types of bacteria react to different conditions. For instance, one type of bacteria, the aerobic,, exist only when oxygen is present in • the liquid) another type, anaerobic, cannot exist where 'oxy-. gen is present, , They are also quite sensitive to tempera.. ture. Harold C. Foster, City Engineer, supervised the construction. F * • 1 2 A G R E E M E N T 3 4 THIS AGREEMENT made the day of 5 1947, by and between the CITY OF CHULA VISTA, San Diego County, 6 California, (hereinafter called the "Owner") and WILLIAM T. - 7 WRIGHT, registered civil engineer, of Los Angeles, California, 8 (hereinafter called "Engineer"); 9. W ITNESSETH: 10 11 THAT WHEREAS, the Owner intends to alter and add to 12 the existing Chula Vista City Sewage Disposal Plant and to 13 install additional interceptor sewer lines; and 14 WHEREAS, the City Council of the City of Chula Vista 15 has passed a resolution to employ the Engineer named herein as 16 Sanitary Engineer for the project; - 17 18 NOW, THEREFORE, the Owner and the Engineer, for the 19 consideration hereinafter named, agree as follows: : .. 20 The Engineer agrees to perform, for the above named 21 work, professional services as hereinafter set forth. 22 The Owner agrees to pay the Engineer for such services 23 a fee of eight per cent (8%) of the cost of the work, with 24 other payments and reimbursements as hereinafter provided, the . 25 said percent being hereinafter referred to as the "basic rate". 26 The parties hereto farther agree to the following 27 conditions: 28 1. The Engineer's Services: For the above "basic 29 rate" the engineer's professional services which Engineer 30 promises and agrees to perform faithfully and diligently shall 31 consist of preliminary studies, investigation and report upon 32 the project, including estimates of quantities and costs; the �e`-1-1- o0o1 1 preparation of complete plans and specifications, including 2 all working drawings, field surveys where necessary, sufficient 3 quantities of plans and specifications for the use of bidders, 4 advice regarding the award and execution of contracts, com- 5 putation of bids, checking the working drawings required of 6 the contractors, the making of chemical and mechanical and . 7 other tests when required, supervision of the layout of the 8 work by the Owner and contractor, and consultation and advice 9 to the Owner during the period of construction, and general 10 supervision and direction of the work to completion. 11 12 2. Inspections: The Owner shall employ and pay 13 the necessary resident field inspectors to properly supervise 14 and inspect the work during construction, the competency and 15 qualifications of such inspector, or inspectors to be approved 16 by the Owner and the Engineer. 17 18 3. Extra Services and Special Oases: If the 19 Engineer is caused extra drafting or other expense due to 20 changes ordered by the Owner, or due to the delinquency or 21 insolvency by the Owner, or as a result of damage by fire, 22 he shall be equitably paid for such extra expense and the 23 service involved at the schedule of rates set forth herein in 24 paragraph 5, in this contract. • 25 • 26 4. Termination, Abandonment, Suspension: The Owner 27 reserves the right to suspend or 'abandon at any time all or any 28 of the construction work designated in this contract or to 29 terminate the contract at any time. In the event of such 30 suspension, abandonment or termination, the Engineer shall be 31 paid pursuant to the schedule of payments set forth in Para- 32 graph 5 of this contract. 1 Should the work be abandoned, suspended, or ter- • 2 minated before specifications, drawings and contract documents 3 are completed, the Engineer shall be paid for the work pur- 4 suant to the schedule of payments set forth in paragraph 5 5 of this contract. 6 In the event that the nature and/or scope of the 7 work is materially reduced, increased or changed from the 8 work originally authorized by the Owner and which reduction, 9 increase or change necessitates major revisions and/or new 10 drawings and contract documents, then either party to this 11 contract shall have the option of terminating this contract, • 12 and a new contract, based upon the conditions existing at the 13 time of such termination, may be executed by the parties to 14 this contract. 15 Immediately upon the execution of this contract, the 16 Engineer shall prepare such preliminary plans, specifications 17 and estimates as are necessary as a basis for the proposed 18 bond issue. No other work shall be done by Engineer until 19 after the bonds are voted. If the bonds are not voted, then 20 the total payment to Engineer shall be the amount specified 21 in paragraph 5, subparagraph (a) hereof. If the bonds are 22 authorized at the proposed election, then the City Council 23 shall by resolution determine when the Engineer shall pro- 24 ceed with the completion of the plans, specifications, working r . 25 drawings and contract documents for the purpose of securing 26 bids. In case the bids received are not satisfactory and 27 the work is abandoned or suspended, the Engineer shall be paid 28 as provided in paragraph 5, subparagraph (e) hereof. 29 30 5. Payments: Payments to the Engineer on account 31 of his fee shall be made as follows, subject to the provisions 32 of paragraph 4. 3. 1 (a) Upon completion of preliminary plans, 2 specifications and estimates preparatory to holding 3 the bond election, the Engineer shall be paid an 4 amount based upon the actual work performed in the 5 preparation of such preliminary data at the rates 6 in the schedule of payments listed below, but 7 not to exceed one thousand dollars ($1,000.00). 8 (b) Upon completion of specifications, 9 working drawings and contract documents, complete • 10 and ready for the acceptance of bid proposals, 11 and approved by the City Council, a sum which with 12 the amount theretofore paid under paragraph 5, sub- 13 paragraph (a) hereof shall be equal to sixty per 14 cent (60%) of the total engineer's fee which will 15 be payable• at the "basic rate" under this agree- 16 ment, computed on the estimated cost of the work. 17 (c) Upon the signing of the construction 18 contract or contracts, Engineer shall be paid • 19 an additional sum sufficient to make a total 20 payment equal to eighty-five per cent (85%) of the 21 estimated total engineer's fee as computed at the 22 "basic rate" on the cost shown by the awarded 23 contract. or contracts. 24 (d) The remaining fifteen per cent (15%) 25 shall be payable to the Engineer upon the satis- 26 factory completion of the work and the acceptance 27 thereof by the Owner. 28 (e) In case of suspension, abandonment or 29 termination of the work, the Engineer shall be 30 compensated for work performed to that date in 31 accordance with the following schedule of 32 payments: 4. 1 Services of Principal Engineer y$50.00 per day 2-Man Field Party 50.00 per day 2 3-Man Field Party 65.00 per day Office Engineer or Designer 30.00 per day 3 Stenographer-Typist 10.00 per day Each Material Test 20.00 per day 4 5 In case of suspension, abandonment or ter- 6 urination of the work, a statement based on the 7 above schedule of payments shall be submitted 8 by the Engineer with a sworn affidavit and such 9 amount shall be due and payable when submitted. 10 (f) No deductions shall be made from the 11 engineers fee on account of penalty, liquidated 12 damages, or other sums withheld from payments 13 to contractors. 14 15 6. Supervision of Work: The Engineer will endeavor 16 to guard the Owner against defects and deficiencies in the 17 work of contractors, but he does not guarantee the performance 18 of their contracts. The Engineer will advise the Owner's 19 inspectors, clerks or other personnel on all matters per- 20 taining to execution of the work and will render similar . 21 service to the contractor. 22 23 7. Definition of Cost of Work: The cost of work 24 as herein referred to, means the actual cost of all labor, 25 materials, equipment rentals and other items used or incor- 26 porated in the work, and shall include the cost or value of • O 27 all such labor, materials, equipment rentals and other items 28 when furnished by the Owner or by any other person, persons, • 29 corporations or agencies. The costs shall not include the 30 engineer's fee or reimbursements or cost of inspections and 31 tests. 32 5. 1 8. Ownership of Documents: The plans, profiles 2 and drawings as instruments of service shall remain the 3 property of the Engineer whether the work for which they 4 are made be constructed or otherwise; provided, however, that 5 one complete set of plans, profiles, drawings, specifications 6 and bidding documents shall be filed in the office of the 7 City Clerk and shall be and remain a public document and, 8 provided further, that upon the construction of the work 9 Engineer shall furnish to the City of Chula Vista for its 10 permanent records a complete set of plans, detailed drawings 11 and specifications showing the location of the work as 12 actually constructed. 13 14 9. Successors and Assignments: This agreement 15 shall inure to the benefit of and be binding upon the Owner 16 and the Engineer, and upon his successor, executor or 17 administrator. This contract shall not be assigned nor 18 shall any interest therein, other than compensation payable 1J hereunder, be transferred without the written consent of 20 the Owner. 21 22 10. Engineer agrees that all engineering work to 23 be done under this cmtract shall be done by persons who are 24 legally authorized civil engineers under the Business and 25 Professions Code, of the State of California, and that all 26 plans, specifications and reports shall be signed by and 27 stamped with the seal of the registered civil engineer in 28 specific and responsible charge of preparation of the same. 29 30 11.
