A RESOLUTION OF TEE CITY COUNCIL OF THE CITY OF ,,
CHULA VISTA, CALIFORNIA, APPOINTING ENGINEER OF te
WORK AND FIXING HIS COMPENSATION AND DUTIES RE-
LATING TO THE PREPARATION OF PLANS AND SPECIFI- •
CATIONS FOR THE CONSTRUCTION OF SANITARY SEWERS
AND INCIDENTAL WORK IN CONNECTION THEREWITH
WITHIN THE SAID CITY.
WHERREAS, it is contemplated and it is the intention of •the
City Councit of the City of Chula Vista, California, proceeding under the
provisions of "Improvement Act of 1911," being.Division 7 of the Streets
and Highways Code of the State of California, and under any acts made
applicable to said Code to carry through proceedings for the construction
of certain sanitary sewers and incidental work in connection therewith in
certain streets, alleys, rights of way and property owned by the said
Cityl. and,
WHEREAS, pursuant to the provisions of Sections 5700 and
5701 of said "Improvement Act of 1911," of said Code ct}ie said City Council
.deem it advisable to appoint an Engineer of Work other than the City Engin-
eer and all of the provisions of said Code applicable to the City Engineer
shall apply to such Engineer of Work; and,
WHEREAS, it is necessary that the Engineer of 'Work be appoint-
ed to make surveys, prepare plans, drawings, maps, profiles and specifica-
tions, together with the estimated costs of said improvement; and
NOW, THEREFORE, -BE IT RESOLVED, that WILLIAM T. WRIGHT, a
Civil Engineer registered under the laws of the State of California be and
he is hereby appointed Engineer of Work in place of the City Engineer,pro- •
vided for under the said "Improvement Act of 19119"
That the said William T. Wright shall do and cause to be done
and performed all the necessary work such as making surveys, the preparation
of plans, maps, drawings, profiles, estimates, specifications, estimating
costs and computing bids, together with the figuring and estimating of and
preparing the assessment on the various parcels of property within the
assessment district at the completion of the work.

The said services shall also include .the furnishing of all
office and field engineering supplies and equipment required in connection
with the performance and duties of such Engineer of Work, together with
transportation and the testing of materials used in the construction of
said improvements when necessary.
And shall also include all necessary stationary and' supplies
in the preparation of any assessment that may be required at the completion
of the work, together with the City's record of such assessment.
That the compensation of said William T. Wright for the per-
formance of the duties of such Engineer of VOrk is hereby fixed at a sum
equal to tenv(k0% .dpencant of the total contract construction cost of said
improvement, which compensation shall be included as incidental expenses and
become a charge against the special assessment district for said improvement.
Payment of said Compensation'shall be made as follows:
An amount equal to six (6%) per cent of the total bid price
of said construction cost shall be collected from the contractor as incidental
expenses and shall be paid to the said William T. Wright at the time of sign-
ing the contract, and the balance of said compensation shall be due and pay-
able at the completion and acceptance of the work and improvement author-
ized by the said City Council.
In the event that any of the proceedings initiated ceases
or is abandoned before the awarding and signing of the contract the City
of Chula Vista shall only be liable for the time and expenses actually
incurred by the said William T. Wright upon the following per diem basis
and each class or type of workman required to perform such services, to-wit:
For personal services of
William T. Wright - $40.00 per day
For each engineering party
of two men - $50.00 per day
For each engineering party
of three men - $65.00 per day

For each stenographer and
typist - $10.00 per day
Tor each office engineer
or designer - $30.00 per day
For each material test - ;20.00
In addition to the above per diem• rates for engineering ser-
vices and work incidental thereto, in the event of such abandonment, the
said City of Chula Vista shall pay the said William T. Wright for the actual
cost for any and all supplies and materials furnished, together with auto-
mobile allowance at the rate of six (60) cents per mile in connection with
the performance of the engineering services under this resolution of appoint-

ment, which said amounts, in the event of such abandonment shall be submit-
ted to this City Council by an itemized sworn statement of such services and
expenses, and shall be prepared, presented and audited in the same manner as
demands upon the funds of the said City.
PASSED AND ADOPTED by-the Council of the City of Chula Vista
at a regular meeting thereof held on the llthday of March ,1947,
by the following vote, to wit
