RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA REPEALING RESOLUTION NO. 9868 AND AMENDING
RESOLUTION NO. 11086, RELATING TO CONSULTANT CONTRACTS
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, Council Policy 102-03 adopted by Resolution No. 9868 (12/4/79)
contains City procedures relating to architectural, engineering and other
consulting purposes in accordance with Government Code Section 4525, as well
as other types of consultant services, and
WHEREAS, Council Policy 102-03 does not apply to contracts for
environmental consulting services required for development and permit
processing in order to comply with CEQA and other environmental laws, but
Resolution No. 11086 contains procedures for letting such contracts, and
WHEREAS, Government Code Sections 4525 et seq. were amended effective
January 1, 1990 to require additional procedures relating to all such
consulting contracts, and
WHEREAS, the City Council is adopting such procedures by ordinance and
making them applicable to all Government Code Section 4525 consulting
contracts as well as all other consulting contracts, pursuant to its Charter
powers.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula
Vista that:
1. Resolution No. 9868 of 12/4/79 (Council Policy 102-03) is hereby
repealed.
2. Section 6.5.2 of Resolution No. 11086 is amended to read:
6.5.2. If the proponent does not desire the ERC to prepare the EIR, or
if the ERC cannot prepare the EIR because of a required expertise, or
the number of EIR/IS's in process, the EIR and candidate CEQA findings
shall be prepared by an environmental consultant selected by the City in
accordance with Chula Vista Municipal Code Sections 2.56.220-240, and
agreed to by the project applicant in accordance with the following
procedures:
The project applicant shall review the list of qualified consultants as
provided in Chula Vista Municipal Code Section 2.56.230 and Section 6.2

and provide the ERC with a list of any consultants which may have a
conflict with the applicant or are otherwise not acceptable. The
applicant shall also provide a written statement of reasons supporting
the position.
The ERC shall within 10 days of the request to initiate the preparation
of the EIR and candidate CEQA findings and the payment of the filing
fee, distribute Requests for Proposals (RFP) to at least three of the
consultants on the list of consultants who are acceptable to the project
proponent. All proposals from the consultants must be received by the
ERC within 15 days of the date of the RFP.
If only one proposal is received by the ERC and the proposal is
acceptable to the project proponent and the ERC, the ERC shall prepare
an agreement for the preparation of the EIR and CEQA findings. Once the
agreement has been signed by the proponent and the consultant
(contractor) and the agreed to reimbursement for the consultants has
been deposited with the city, the agreement shall be signed by the City
pursuant to Chula Vista Municipal Code Section 2.56.220.
If more than one proposal is submitted, they shall be graded by the ERC
in accordance with a rating sheet developed by the ERC. The proposal
with the highest rating shall be invited by the ERC to enter into an
agreement with the ERC and the project proponent to prepare the draft
and final EIR and candidate CEQA findings.
Once the agreement is signed by the project proponent and the consultant
(contractor) and agreed to reimbursement for the consultant has been
deposited with the city, the agreement shall be signed by the City
pursuant to Chula Vista Municipal Code Section 2.56.220.
3. Section 6.6 of Resolution No. 11086 is amended to read:
Section 6.6 Public Projects. When a department or agency of the City
of Chula Vista is proposing to carry out a project which may
significantly effect the environment, it shall prepare a preliminary of
the draft EIR either directly or by contract in accordance with the
procedure set forth in Section 6.5.2.
