The owner of the property at the northwest corner of "C" Street and
Del Mar Avenue has made application for the vacation of a 7 foot wide
strip of "C" Street along the frontage of the property . At its
meeting of November 27 , 1984 , the Council adopted Resolution No. 1185
declaring its intention to vacate and setting the public hearing for
December 18 , 1984 .
RECOMMENDATION:
That the Council hold the subject public hearing to consider the
vacation of portion of "C" Street and approve the resolution ordering
said vacation.
BOARDS/COMMISSION RECOMMENDATION:
No Board or Commission action is necessary for this matter . However ,
the Planning Staff had no objection to the vacation.
DISCUSSION:
The 1 .25-acre parcel at the northwest corner of "C" Street and Del Mar
Avenue (Assessors Parcel No. 563-301-03) was recently annexed to the
City. Mr Mitchell Angus , owner of the land, with intentions to
develop the property, has applied to the City to vacate a 7 foot wide
portion of the street right of way. The frontage of the property is
442 feet.
Presently there is no curb , gutter or sidewalk at the subject
location. The property to the west was developed in 1969 and has
installed improvements. The ultimate curb to curb width of the street
is 36 feet. Extending the existing curb, gutter and sidewalk easterly
would result in the northerly right of way being 17 feet in back of
the curb. The City ' s normal requirement presently is maintaining a
distance of 10 feet from the face of the curb . The Planning and
Engineering Departments have no objections to vacating the subject
right of way.

The City vacated 10 feet of "C" Street right of way along the frontage
of the above mentioned property to the west in 1969 when that property
was developed . At that time the City maintained only 7 feet back of
the curb. All of the utility companies have been contacted regarding
the proposed vacation. San Diego Gas and Electric Company and Pacific
Bell have requested that we reserve easements over all of the parcel
being vacated for their facilities. The other companies have no
objections.
In accordance with Part 3 , Chapter 3 of the California Streets and
Highways Code, this public hearing has been properly noticed by mail ,
publishing in the Star News and by posting notices on site .
If the Council approves the subject vacation , the staff is prepared to
return with a resolution ordering same .
A transparency is available for Council viewing.
