ITEM TITLE: Resolution /961/Initiating the "Broadway/Palomar Street
Reorganization" involving annexation of approximately 23 acres
of uninhabited territory to the City of Chula Vista, and
concurrent detachments from the Montgomery Fire Protection
District, Montgomery Sanitation District, San Diego County
Flood Control District-Zones 3 and 4, and County Service Area
No. 62-Montgomery pursuant to the provisions of the District
Reorganization Act of 1965 (DRA)

The proposed City-initiated reorganization involves the annexation of
approximately 23 acres of uninhabited territory located at the northwest
corner of Broadway and Palomar Street to the City of Chula Vista, and
concurrent detachments from the Montgomery Fire Protection District,
Montgomery Sanitation District, San Diego County Flood Control District-Zones
3 and 4, and County Service Area No. 62-Montgomery. The City Council , at
their meeting of November 27, 1984, adopted Resolution No. 11851 authorizing
the payment of all annexation fees on behalf of Sunbelt Holdings, Inc. in
order to expedite the application process through LAFCO.
Sunbelt Holdings, Inc. , a major landowner within the proposal area, with the
support of its two tenants (Ralph's Grocery Company and Target Stores) , has
consented to the inclusion of their land in the proposed reorganization.
Please see Exhibit A which depicts the proposal area in question.
The District Reorganization Act of 1965 (Government Code Section 56140 et
seq. ) provides that an affected City may initiate a reorganization proposal by
the adoption of a "resolution of application." The said resolution would
become the initiating document and would accompany the annexation application
to LAFCO.
RECOMMENDATION: That Council adopt a "resolution of application" initiating
the proposed "Broadway/Palomar Street Reorganization" involving the annexation
of approximately 23 acres of uninhabited territory located at the northwest
corner of Broadway and Palomar Street to the City of Chula Vista, and
concurrent detachments from the Montgomery Fire Protection District,
Montgomery Sanitation District, San Diego County Flood Control District-Zones
3 and 4, and County Service Area No. 62-Montgomery.

DISCUSSION:
General Description of the Proposal Area (Please see Exhibit A)
The proposal area is located at the northwest corner of Broadway and Palomar
Street in the unincorporated territory of San Diego County. The 23-acre area,
which is contiguous to the City boundary on two sides, is comprised of five
parcels of land and the adjoining street rights-of-way. The land in question
is fully developed with mixed retail commercial uses and associated parking
lot areas. Ralph's Superstore and Target are the major tenants which occupy
the territory.
General Plan and Prezoning
The proposal area is designated in its entirety as "Retail Commercial" on the
plan diagram of the Land Use Element of the Chula Vista General Plan. The
City has not yet prezoned the territory in question. According to LAFCO
staff, the area's current prezoning status should not preclude the processing
of this proposal since the area is developed in accordance with the General
Plan, and because the proposal area is within the City's Partial
Sphere-of-Influence (Montgomery Area) , which was adopted by LAFCO in November
1981 . Following annexation, then, the City could initiate zoning of the area
consistent with the General Plan.
The County's South Bay Community Plan designates the territory 15 (Heavy
Industrial ) and County zoning is currently M-52 (Limited Industrial ) and C-36
(General Commercial ) .
Environmental Review
The City's Environmental Review Coordinator has reviewed the proposed
reorganization and has determined that annexation of the existing commercial
development would not require environmental review and, therefore, would be
exempt therefrom.
However, once the proposal is filed with LAFCO for processing, LAFCO, as lead
agency, will make a final determination.
Protest Provisions of the District Reorganization Act - DRA (uninhabited
territory)
The proposal area is considered uninhabited territory since it has less than
12 registered voters (actually none) residing thereon. Under the protest
provisions of DRA, a proposal is terminated if protests received represent
more than 50 percent of the assessed value of land within the territory
proposed for annexation. If protests are received which represent more than
25 percent of landowners who also own more than 25 percent of the assessed
value of land within the territory, then an election is required. Under DRA
assessed va ue of improvements is not taken into consideration.

It should be noted that this proposal is supported at this time by only one
landowner (Sunbelt) , whose 11 .74 acre holding is valued at $780,583.00, or
about 46 percent of the territory 's total land assessed valuation.
According to current tax role land valuations, consent from any of the
remaining four property owners within the territory would preclude both
termination of the proposal and successful defeat by election.
Submittal to LAFCO
The application package was officially filed with LAFCO on November 28, 1984.
The subject "resolution of application" will be submitted shortly after its
adoption by Council .
FISCAL IMPACT: The City's share of property and sales tax revenue generated
from the annexing area probably would be outside the new Master Property Tax
Agreement. As a result, the split of the property tax between the City and
the County would need to be separately negotiated.
