ITEM TITLE: Report on Municipal Code Amendment to allow Planning
Commission approval of Tentative Maps for one-lot condominiums

On October 15, 1984, the Council continued this item for one week to assess
its impact. We offer the following additional comments for clarification:
1. This amendment would apply to all requests for condominiums involving a
single lot, either undeveloped property or conversions.
2. As a prerequisite, all of the ordinance condominium standards would have
to be complied with.
3. Any tentative map action by the Commission can be appealed to the Council
if desired.
4. These actions are felt to be ministerial , routine and apart from zoning or
site plan and design issues. This is confirmed by the fact that often the
zoning is in place, plans have been received and approved by the Building
and Housing Department, permits issued and construction initiated at the
time a tentative one-lot subdivision map is processing.
Attached for Council is information on one-lot condominium projects and maps
processed by the City since January 1983. As can be seen, the vast majority
of cases (83%) are new developments while 17% are conversions; 92% of the
requests involve a single lot and 92% were approved. The one case which was
denied, "Georgian," could not meet the condominium standards and was rejected
on that basis by the City Council. It should also be noted that actions
between the Commission and Council are 100% consistent on each application
request.
