As one of the conditions of approval of a conditional use permit for ADMA
Company to construct a tennis court on one lot of Peppertree Estates, it must
obtain an encroachment permit to build within a 10-foot wide drainage easement
which has been dedicated to the City. In accordance with Section 12.28.010 of
the Chula Vista Municipal Code, the Council must consider this matter before
authorizing the City Engineer to issue the permit.
RECOMMENDATION: That the Council adopt the subject resolution approving
Encroachment Permit No. PE042 and authorize the City Engineer to issue same.
BOARDS/COMMISSIONS RECOMMENDATION: This encroachment permit does not
require a board or commission action. However, the Zoning Administrator
approved a conditional use permit for this project at its proposed location.
DISCUSSION:
Recently, ADMA Company, Inc. developers of Peppertree Estates Subdivision,
submitted a request for a conditional use permit to allow a tennis court to be
built on Lot 13 of that subdivision. The court is to be for the use of the
property owners within the subdivision. The permit was granted with several
conditions including:
1 . The applicant shall provide access to the storm drain to the satisfaction
of the City Engineer.
2. An encroachment permit shall be obtained prior to issuance of a building
permit for construction within the City's drainage easement which is
subject to City Council approval.
By letter dated October 11 , 1984, ADMA Company, Inc. applied for an
encroachment permit as directed. The proposal is to place concrete paving
within a portion of the City's drainage easement and construct a 12-foot high
chain link fence which crosses the easement in two places. These facilities
will be part of the proposed tennis court.
We propose that the permit require that City crews have access to the drainaat �y
facilities at all times.
