HomeMy WebLinkAboutReso 1990-15589 RESOLUTION NO. 15589 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DENYING APPEAL FROM PLANNING COMMISSION REVOCATION OF CONDITIONAL USE PERMIT PCC-87-39M REGARDING AN R.V. STORAGE FACILITY AT 1375 BROADWAY - BROADWAY EQUITIES LTD. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the applicant, Broadway Equities Ltd. established an R.V. storage 1 ot five years ago without obtaining a major use permit from the City, and WHEREAS, upon annexation to the City of Chula Vista, zoning enforcement personnel received complaints that storage contained within this lot was unsightly and the owners were notified that the lot was established illegally and that a conditional use permit must be obtained or the use must be abated, and WHEREAS, an Initial Study IS 87-56M of possible adverse environmental impacts of the project was conducted by the Environmental Review Coordinator on May 22, 1987 who concluded that there would be no significant environmental effects and recommended that a Negative Declaration be adopted although it is not necessary to adopt the Negative Declaration if the majority vote is for denial of the major use permit, and WHEREAS, the Montgomery Planning Committee, at their meeting of August 5, 1987, voted to recommend denial of the conditional use permit and to schedule abatement effective March 31, 1988, and WHEREAS, the Planning Commission, at their meeting of February 10, 1988, voted unanimously to deny the application for a major use permit and to schedule abatement effective April 30, 1988, and WHEREAS, on July 12, 1988, the City Council granted applicant's appeal and approved a Conditional Use Permi t, PCC-87-39M upon conditions, and WHEREAS, on October 25, 1989, the Planning Commission voted 4-2 to revoke PCC-87-39M due to applicant's failure to comply with said conditions, and applicant has timely appealed said revocation, and WHEREAS, on December 7, 1989, applicant filed a timely application for a new or extended Conditional Use Permit since the revoked permit would have otherwise expired on January lO, 1990, and WHEREAS, on January 3, 1990, the Montgomery Planning Committee voted unanimously to recommend denial of PCC-90-25M, and Resolution No. 15589 Page 2 WHEREAS, on January 24, 1990, the Planning Commission made findings and denied the Conditional Use Permi t, PCC-90-25M and applicant has timely appealed, and WHEREAS, said appeals have been duly noticed and come on for public hearing on April 17, 1990, and was continued to May 15, 1990, at which testimony was taken. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby affirm the revocation of Conditional Use Permit PCC-87-39M. BE IT FURTHER RESOLVED that consideration of the application for new or extended Conditional Use Permit is continued to June 12, 1990.
