Council accepted the report and directed staff to return with a resolution and agreement modifying condition 17 of Resolution 11428. RECOMMENDATION: Council approve the resolutions modifying the conditions of Telegraph Canyon Road for the Charter Point and Telegraph Point Subdivisions and approving the Council 's intent for the improvement of Telegraph Canyon Road. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Both Charter Point Subdivision and Telegraph Point Subdivision were required to improve Telegraph Canyon Road on a four-lane temporary alignment in front of their prospective subdivisions and offsite in a westerly direction to the existing divided four-lane section just easterly of Paseo Ladera. As discussed in the report of July 24, that condition is being modified to provide that Charter Point, Telegraph Point, and prospective future developers will widen their frontages along Telegraph Canyon Road as a four-lane divided highway. When the property on the south side of Telegraph Canyon Road is ready for development, they would be required to widen the existing road to a six-lane facility. The first subdivision which will be affected by this will be Charter Point. Their new condition will require that they construct a four-lane divided highway with a landscaped median, two bike lanes, and street lights adjacent to their development with a safe and adequate transition. The limits along Telegraph Canyon Road for Charter Point will include the full intersection at Otay Lakes Road and the frontage along the Pacific Bell 's telephone switching plant. They, as well as future developers, will then be Page 2, Item 7 Meeting Date 1U/iO/a4 required to provide adequate and safe transitions offsite of the full improvements. Exhibit A illustrates the existing condition of Telegraph Canyon Road, the interim condition as discussed in this resolution, and the ultimate width of Telegraph Canyon Road when it is fully developed on both si des. It should be pointed out that if EastLake progresses ahead of the developments along Telegraph Canyon Road, then they would be required to install these improvements with the City's understanding that a reimbursement district would be held for the purpose of reimbursing EastLake for their offsite improvements. Both Resolution No. 11428 (Charter Point Subdivision) and Resolution No. 10767 (Telegraph Point Subdivision) and condition no. 6 of the attached Planning Commission resolution needs to be modified to provide the new conditions for each subdivision. As each project is completed or built, the developers responsible for constructing the improvements will be required to acquire any additional right-of-way necessary from United Enterprises. The City Council , however, would be the appropriate body to authorize condemnation proceedings for the necessary right-of-way through the public hearing process.
