HomeMy WebLinkAboutAgenda Statement 1984/09/25 Item 12 • COUNCIL AGENDA STATEMENT Item 12 Meeting Date 9/25/84 ITEM TITLE: Resolution //777-:.— Regarding Negotiated Property Tax Exchange Relating to Jurisdictional Changes - Lower Sweetwater Reorganization (City of Chula Vista) SUBMITTED BY: Director of Planning (QV (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager(/ :./ The City Council, at its regular meeting of August 21, 1984, adopted Resolution No. 11742 consenting to negotiate with the County of San Diego outside the bounds of the Master Property Tax Exchange Agreement for the proposed Lower Sweetwater Reorganization. The County and LAFCO, after reviewing the subject resolution, recommended that it should be amended to include more specific language regarding the methodology of property tax exchange for the proposed reorganization. The attached amended resolution is in conformance with a similar resolution adopted by the County Board of Supervisors on August 21, 1984. RECOMMENDATION: That Council adopt the attached resolution. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The subject reorganization proposal was filed with the Local Agency Formation Commission on August 29, 1984. Prior to the Commission's consideration of the proposal, the City and County must adopt similar resolutions specifying the methodology to be used in determining the allocation of base property taxes and the annual tax increment. Council Resolution No. 11742, adopted on August 21, 1984, is substantially similar to that of the County's, but needs to be amended to include more specific language regarding the property tax exchange methodology. The County's resolution was forwarded to the County Auditor, who will ultimately determine the allocation of property taxes based on the methodology described in said resolution. The City's resolution must now be amended to include the following language in order to promote conformity and the orderly processing of the subject reorganization proposal. "The methodology used to determine the property tax exchange for the proposed reorganization will be as follows. All of the base and all of the annual tax increment from the detaching special districts (Lower Protection District, County Librar , and County Flood Control SDistrict) shall be transferred to the City of Chula Vista. The County General Property Tax is not changed." • • Page 2, Item 12 Meeting Date 9/25/84 FISCAL IMPACT: It has been estimated through negotiations with the County (outside the bounds of the Master Agreement) , that the City will receive between $5,000 and $6,000 of revenue from all revenue sources including base year property taxes from the proposal area post annexation. In addition, in future years the City would receive 41% of the area's growth in value (annual tax increment) . It should be noted that the property tax portion of the estimated revenue will be ultimately determined by the County Auditor in accordance with the methodology agreed upon by the City and County.
