SUBMITTED BY: Community Development Direct. 4/5ths Vote: Yes No X ) REVIEWED BY: City Manager The South Bay Ambulatory Surgical Center is currently under construction at the southeast corner of Landis and Davidson Streets. The contractor for this project has requested that the City allow a construction trailer on property (formerly the Glenn 's property) recently acquired by the City. RECOMMENDATION: That the City Council adopt the attached resolution entering into the rental agreement with Trepte Construction Company, Inc. for the use of property at 263 Landis Avenue. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The use of City property by the South Bay Ambulatory contractor will be temporary in nature and expected to extend through March 1985. The rental agreement requires that the contractor maintain an insurance policy for at least $1 million liability and that the City of Chula Vista be named as additional insured to that policy. A rent of $50 per month is recommended and the contractor must obtain all permits and extensions necessary for utilities to the trailer. The agreement also stipulates that the tenant shall not interfere with any construction operations or City operations taking place on the existing City property, public parking lots, or adjacent areas. The rental can be extended, by mutual agreement, and the City has the right to terminate within 15 days of notice if the terms are not fulfilled by the tenant. FISCAL IMPACT: Rental income from August 22 through March 22 will be $350.00. The City will be named as an additional insured to the contractor's $1 million liability insurance policy, therefore, no financial liability to the City is anticipated. WPC 1160H - _-
