HomeMy WebLinkAboutReso 1990-15581 RESOLUTION NO. 15581 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING APPRAISALS AND SALES OF PROPERTIES IN OPEN SPACE DISTRICT NO. 3 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the "Grading Deviation Policy" (Resolution No. 12751 on September 23, 1986) established Council Policy No. 460-02, providing the procedure and criteria to be used to identify and sell City dedicated open space property for the specific purpose of correcting a grading deviation made at the time of subdivision development, and WHEREAS, in the Rancho Robinhood Development, four applications were made to purchase adjacent open space property meeting the requirements of the policy to be eligible for sale, and WHEREAS, on November 14, 1989, Council approved, by Resolution No. 15382, the mail-in ballot results and the Negative Declaration on IS-89-73 relating to such sales, and WHEREAS, the applicants have complied with the procedures established in the Grading Deviation Policy which includes: a mail-in ballot, environmental review and finally a market value appraisal, and WHEREAS, Mr. Tom Money, real estate appraiser, was hired to prepare appraisal reports for the four applicants and the market values of the properties are as follows: Applicant Market Value Estimate Peterson 311 Surrey Drive $4,000 Taylor 315 Surrey Drive 4,000 Thompson 347 Surrey Drive 2,000 Kuebler 948 Buckaroo Drive 3,000 WHEREAS, upon Council approval of the report and authorization to sell properties, the applicants will purchase the properties from the City for the market value and the City will prepare the necessary deeds to dispose of the properties, such deeds including restrictions on use set forth in Paragraph I. F. of Policy No. 460-02, and WHEREAS, the funds derived from the sale of open space property will be credited to reserve balance of the affected district. Resolution No. 15581 Page 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the appraisals and sales of properties in Open Space District No. 3. BE IT FURTHER RESOLVED that staff is directed to prepare deeds reflecting the proper legal descriptions and use restrictions required by Policy No. 460-02, and the Mayor is authorized to execute them and cause them to be delivered to the parties and recorded.
