This item involves proposed revisions to Title 19 of the Municipal Code
relating to carnivals and circuses.
RECOMMENDATION: That Council concur with Planning Commission recommendation.
BOARDS/COMMISSIONS RECOMMENDATION: On June 27, 1984, the Planning
Commission unanimously (7-0) recommended that Council enact an ordinance
amending Title 19 of the Municipal Code relating to carnivals and circuses in
accordance with Resolution PCA-84-3 with the exception of deleting the
limitation of four circuses or carnivals in a given 12-month period (ref.
19.58.042)c.
DISCUSSION:
Present Provisions
Carnivals, circuses and fairgrounds are presently listed as unclassified uses
by the Municipal Code and require Planning Commission approval . The Code, as
written, treats these uses as permanent facilities; however, normally
carnivals and circuses tend to be temporary in nature whereas fairgrounds are
more permanent.
Conditional use permit applications handled by the Planning Commission take a
minimum of 27 days to process from the date of filing to the Commission
meeting. Applications handled by the Zoning Administrator can be processed in
approximately 14 days.
Proposed Revisions
Typically, applications for carnivals and circuses are filed shortly before
the dates requested on the application, thus the process time required for
Planning Commission action could in effect prohibit these uses. The proposed
revisions to the Code allows the applications to be handled by the Zoning
Administrator who would also have the option of referring the matter directly
to the City Council in which case a public hearing would be required. The
revisions also establish general development standards (see 19.58.042 A
through F attached) relating to the following:

1 ) Access and parking;
2) Dust, noise, vibration, and glare;
3) Hours of operation;
4) Duration of use;
5) Business license;
6) Security;
7) Sanitary facilities;
8) Fire regulation;
9) Weed abatement; and
10) Bonding.
The proposed revisions would allow applications to be processed faster and
establishes standards under which these uses must operate. There would be no
loss in the degree of control and residents within 300' of the proposed
operation would receive a hearing notice.
Modification of Planning Commission Recommendation
The Planning Department recommended and the Planning Commission accepted a
limitation of no more than four circuses or carnivals in any 12-month period.
This limitation was recommended to minimize impacts on the community and
adjacent land uses. In addition, the Parks Department indicated that in the
past they typically have processed four requests or less per year.
After giving the matter further consideration, the Planning Department has
concluded that setting an arbitrary limitation on the number of circuses or
carnivals which could be held each year would prove detrimental to any request
coming in the later part of a year. If four circuses or carnivals were
authorized prior to September or October when the more traditional "Fiesta de
la Luna" or Halloween carnivals are held, they would be precluded from doing
so. Thus, it is recommended that the limitation on the number of circuses or
carnivals allowed each year be eliminated, and be controlled at the discretion
of the Zoning Administrator.
