Resolution ///A9-5--Approving deferral of undergrounding utility services at 391 Roosevelt Street SUBMITTED BY: City Engineer 9r7 (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager 0 The City Code requires that all new structures, except for room additions or single family dwellings, must be served by underground utilities. The owner of the property at 391 Roosevelt St. is adding a second dwelling unit to the existing house. This constitutes the requirement to place all existing overhead utilities underground. The owner has requested a deferral of the undergrounding requirements. According to Chapter 12.32 of the Municipal Code, the request must be considered by the Council at a public hearing. RECOMMENDATION: That the Council hold the subject public hearing to consider the deferral request and adopt a resolution deferring the undergrounding requirements. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: On March 22, 1984, Mr. Larry Armbrust, owner of the property at 391 Roosevelt Street applied for a building permit to add a living unit to the existing single family dwelling at that site. In accordance with Section 15.32.030 of the City Code, he is required to provide underground service for all utilities. Mr. Armbrust has applied for a deferral of these undergrounding requirements stating that: 1 . It is impractical in that "all other homes are fed from overhead on Roosevelt," and that the nearest pole to feed an underground service is over 125 feet from his building site. 2. It would be desirable to do the undergrounding as a part of an overall undergrounding district. Provisions called out in Section 15.32.070 of the Code allow for a deferral of the undergrounding if all of the following facts exist: 1 . That extraordinary conditions exist to the extent that enforcement of this subsection would result in unnecessary hardship to the owner or utility company; Page 2, Item 4,4a Meeting Date 1/11/84 2. That such a deferral will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of the neighborhood. A field investigation revealed that the existing dwelling, as well as the rest of the single family homes along this block of Roosevelt Street, are served by overhead lines. According to SDG&E, the nearest pole that may be used for undergrounding is located approximately 125 feet from the property. The range of costs to the owner to trench and install electrical , phone and cable T.V. lines is between $7,000 and $10,000. This represents 14% to 20% of the estimated valuation of the onsite improvements of $50,000. This portion of Roosevelt Street is not listed on any priority list for the formation of an undergrounding district. The existing overhead services will remain indefinitely. One additional line would hardly be noticeable. Based on these findings, the benefits derived from enforcing the underground requirements do not outweigh the cost. It is the recommendation of this department that the Council approve the request and direct the City Engineer to have a deferral agreement prepared for the Council 's approval . This agreement will include the condition that the owner will not protest in the case that an undergrounding district is formed. Slides are available for Council viewing. FISCAL IMPACT: None.
