Naiman, real estate agent (Pioneer Mortgage Sales Co. ) for a 2.34 acre parcel of land located at the northwest corner of Del Mar Avenue and Bayview Way, in the unincorporated territory of San Diego County. The proposed reorganization involves annexation to the City of Chula Vista and concurrent detachments from the San Diego County Flood District - Zone 3 and the Lower Sweetwater Fire Protection District. The proposal area is described in Exhibit A and depicted on Exhibit B of this report. The San Diego Local Agency Formation Commission adopted a resolution approving the subject reorganization proposal at their meeting of June 4, 1984, and authorized the Chula Vista City Council to initiate reorganization proceedings. RECOMMENDATION: That Council adopt a resolution ordering the proposed "Del Mar Avenue/Pioneer Reorganization" involving annexation to the City of Chula Vista and concurrent detachments from the San Diego County Flood Control District - Zone 3 and the Lower Sweetwater Fire Protection District. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable DISCUSSION: The proposal area, which is located at the northwest corner of Del Mar Avenue and Bayview Way in the unincorporated territory of San Diego County, contains 2.34 acres of land. The applicant has requested annexation to the City in order to obtain comprehensive municipal services for one existing single-family dwelling and a future residential development. General Plan and Prezoning The subject property is designated "Medium Residential (7.3 du/ac)" on the Land Use Element of the County General Plan. The County has applied the RV-15 land use regulations to the subject parcel (formerly the R-2 zone) . The said regulations permit a maximum net density of 14.5 du/ac. , with lot size at a minimum of 6,000 square feet. The Plan Diagram of the Land Use Element of the Chula Vista General Plan designates the parcel "Medium Density Residential (4-12 du/ac)". Page 2, Item 5 Meeting Date7/10/84 On October 19, 1978, the City Council adopted Ordinance No. 1832 prezoning the unincorporated area in the northwest quadrant of the intersection of "C" Street and North Second Avenue to "R-1" (single-family residential zone, 7,000 sq. ft. minimum lot size) . The annexing parcel is contained within the R-1 "prezoned" area. Existing and Proposed Development The proposal area is presently occupied by a single-family dwelling, which is located at the easterly end of the property near Del Mar Avenue. The applicant has indicated that he intends to develop the property at a future date, but no development plans have been submitted to the City to date. The applicant is cognizant of the fact that the "R-1 " prezoning will officially apply to the subject property concurrent with annexation completion, and that the property's future development must be consistent with the zonal regulations of the "R-1" district, unless a rezoning application is approved by the City Planning Commission and City Council. Environmental Review On March 2, 1984, the City's Environmental Review Coordinator determined that the proposed annexation of a single parcel occupied by one single-family dwelling is categorically exempt (Class 3(a) exemption) from environmental review. However, at the time development plans are submitted, additional environmental review will be required. LAFCO Action At a public hearing on June 4, 1984, LAFCO adopted a resolution approving the subject reorganization proposal . By said resolution, LAFCO designated the City of Chula Vista as the "conducting authority" and authorized the City Council to initiate proceedings in compliance with LAFCO's resolution and without notice and hearing. Municipal Services The City's Public Works, Fire, and Police Departments have concurred that the subject reorganization area can be served immediately upon annexation without an increase of manpower and/or equipment. FISCAL IMPACT: The City of Chula Vista and the County of San Diego have adopted a Master Property Tax Exchange Agreement which pertains to this jurisdictional change. The City will receive property tax revenues from the subject territory in accordance with the agreement currently in effect.
