This ordinance would delete the notice requirements in the Municipal
Code prior to towing an illegally parked vehicle .

DISCUSSION:
At its meeting of May 8 , 1984 , the City Council had before it a proposed
amendment to Section 5 .58 .060 of the Chula Vista Municipal Code relating
to notice requirements for towing automobiles . The purpose of that
amendment was to make it clear that the notice did not apply in emergency
situations .
'ust prior to the meeting, the towing operators contacted the Director
,f Public Safety to inform him that they had been unaware of the notice
provisions and that if enforced, these provisions would be an unreason-
able regulation . It would require them to make two trips prior to towing
an illegally parked automobile--one trip for notice purposes and a second
trip for the actual towing .
There are provisions in the Vehicle Code which already set out notice
requirements . Our additional notice provisions are not necessary and
we recommend deletion of the entire section from the Municipal Code .
The whole area of regulation of private towing will be examined in the
future to determine if any further measures are recommended in this area .

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION RECOMMENDING THAT CITY COUNCIL REZONE
0.65 ACRES 200 BLOCK OF EUCALYPTUS COURT FROM
R-1-15 TO R-1
WHEREAS, a duly verified application for a rezoning was filed with
the Planning Department of the City of Chula Vista on April 13, 1984, by Frank
E. Ferreira, and
WHEREAS, said application requested rezoning a 0.65 acre parcel
(Parcel 1 of P.M. 55) in the 200 block of Eucalyptus Court from R-1-15 to R-1 ,
and
WHEREAS, the Planning Commission set the time and place for a hearing
on said rezoning application and notice of said hearing, together with its
purpose, was given by its publication in a newspaper of general circulation in
the city and its mailing to property owners within 300 feet of the exterior
boundaries of the property at least ten days prior to the hearing, and
WHEREAS, the hearing was held at the time and place as advertised,
namely .7:00 p.m. , May 9, 1984, in the Council Chambers, 276 Fourth Avenue,
before the Planning Commission and said hearing was thereafter closed, and
WHEREAS, the project is exempt from environmental review as a Class
3(a) exemption.
NOW, THEREFORE, BE IT RESOLVED THAT from the facts presented to the
Planning Commission, the Commission has determined that the rezoning is
consistent with the City of Chula Vista General Plan and that public
necessity, convenience, general welfare and good zoning practice support the
rezoning from R-1-15 to R-1 .
BE IT FURTHER RESOLVED THAT THE PLANNING COMMISSION recommends the
the City Council adopt an ordinance to rezone Parcel 1 of Parcel Map 55 from
R-1-15 to R-1 , and that a copy of this resolution be transmitted to the owners
of the property and the City Council .
PASSED AND APPROVED BY THE PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA,
this 9th day of May, 1984 by the following vote, to-wit:
AYES: Commissioners Pressutti , E. Guiles, Shipe, Cannon and O'Neill
