On April 3, 1984, by Resolution 11574, Council established the Hidden Vista
Village Sewer Reimbursement District - Rice Canyon Trunk. A report was
prepared which specifies the methodology to be used in administering the
District. That report stipulates that properties which connect that have not
specifically been considered in the district shall pay the appropriate fee and
that those funds shall be deposited in the City's General Fund. At the
request of Councilman Scott, Council directed staff to modify the resolution
to clarify collection of fees within drainage area but not within the district.
RECOMMENDATION: That Council adopt the resolution.

DISCUSSION:
On April 3, 1984, Council conducted a public hearing relative to the formation
of a sewer reimbursement district for a portion of the Rice Canyon Trunk Sewer.
Considered during that hearing was a report written for the reimbursement
district which discussed the method of repayment. Exhibit "D" of that report
listed the dwelling units to be assessed within the El Rancho Del Rey Specific
Plan area and other areas which lie within the gravity basin (Dreyfuss and
Bonita Point properties). Council established the district by Resolution
11574.
The district was based upon those properties west of I-805 not paying into the
district and the City not being reimbursed for those properties. To offset
that subsidy, the City will collect funds from those properties connecting to
the sewer but not within the district (i .e., Lynwood Hills and Bonita Road
properties).
The City Engineer was directed to return to Council with a resolution
specifically addressing properties which might connect to the facilities
within the drainage basin but for which dwelling unit factors were not
specifically designated in Exhibit "D" of the report.

Paragraph III D of the report read: "Should any of the parcels in the Lynwood
Hills area or any area capable of connecting to the system (and not
specifically considered such as an area outside of the gravity basin) connect
in the future, those parcels will be charged the appropriate fees plus
interest and the funds deposited in the City 's general fund."
Staff recommends that the funds be deposited into the Sewer Income Fund rather
than the General Fund as originally stated in the report because of our
contribution to construct the sewer from the Sewer Income Fund. Council
requested that this facet of the methodology be further expressed to clarify
the proposed disposition of funds collected from those undesignated
properties. To that end it is stated that:
1 . My properties connecting to the Rice Canyon Trunk System in the future
which are not listed in Exhibit "D" of the report accompanying Resolution
11574 shall pay fees based on the number of equivalent dwelling units
being connected.
2. Those fees shall be deposited in the City's Sewer Income Fund.
