Mr. Lyman M. Kidder, owner of the property at 314 Surrey Drive, has applied
for an encroachment permit to construct a wooden deck at the rear of the house
which is proposed to extend into the City's open space approximately 7.5
feet. In accordance with Section 17.08.450 of the Municipal Code, this
request must be considered by the City Council .
RECOMMENDATION: That the Council approve the request for an encroachment
permit and authorize the City Engineer to issue same.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The owner of Lot 136 of Rancho Robinhood III subdivision is proposing to
install improvements on his property. Along with landscaping, a wooden deck
is proposed to be built at rear of the house. In order to take advantage of
the westerly view, the owner desires to extend the deck over the existing
slope, into the City's Open Space Lot No. 246 a maximum of 7.5 feet. A total
area of 150 square feet of deck would lie within the open space.
The Department of Parks and Recreation has reviewed the request. Upon a field
investigation, it was found that this proposed encroachment would not obstruct
the view of any of the neighboring residents or interfere with the purpose of
this open space. There is a concern, however, regarding a sprinkler line
running along the top of the slope. A condition of approval of the permit
would be that any relocation of the irrigation line would be the applicant's
responsibility.
Due to the large area of this open space lot, the deck will not be obtrusive
to homeowners to the south of the open space. There is a natural canyon
between the properties.
The City Council considered a similar request from the adjacent property owner
directly to the west of this property at its meeting on 4-24-84.
