Guidelines for handling such requests are contained within Council Policy 570-02 adopted on July 5, 1983. The attached agreement, executed in behalf of the Beth Torah Congregation, provides assurance of compliance with the conditions set forth in the Council Policy. RECOMMENDATION: That the City Council adopt the resolution 1 . authorizing the Mayor to execute the Agreement with the Beth Torah Congregation; 2. authorizing the requested connection to public sewer; and 3. directing the City Clerk to record the Agreement with the Office of the Recorder of San Diego County once the extension of sewer service is approved by the City of San Diego. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: A request to permit sewer service to property beyond the City boundary has been submitted by the Beth Torah Congregation of Chula Vista, Inc. (See Exhibit "A." ) That organization proposes to erect a synagogue upon property identified upon the attached Exhibit "B." Council Policy 570-02 sets forth policy and procedures relative to connection of properties not within the City boundary. (See Exhibit "C.") The property in question is in conformity with the first two requirements of the policy: 1 . The property could logically be annexed to the City. (Note that no formal petition for annexation has been filed. ) 2. The property is adjacent to an existing public sewer (Rice Canyon Trunk) . Page 2, Item 7 Meeting Date 5/1/84 Because of the topography of the site and its panhandle configuration, it will be necessary that sewer service be obtained at the side of the property rather than in the adjacent Lynndale Lane. (See Exhibit "B.") Such service is not likely to benefit property other than that of the Beth Torah Congregation. Items 3 through 8 of the Council Policy set forth specific conditions to be honored if approval to connect is granted. The attached agreement reflects these conditions. Annexation of the Beth Torah site will likely be dependent upon annexation of other nearby properties. There is no current movement to annex any of those nearby properties even though some property owner interest has been shown during the last two years. FISCAL IMPACT: City will receive standard fees and charges plus a minimum capacity charge of $1 ,000. Total fees are estimated to be approximately $4,600. WEH:nr/LY086 WPC 0964E C .tCS i9 //‘/
