Avenue, to abate a nuisance SUBMITTED BY: Director of Building & Housin t%� 9 Housing ;.V s Vote: Yes No X ) REVIEWED BY: City Manager On September 13, 1983, Mr. Wheeler appeared before the City Council to request additional time be granted for him to abate the nuisance at 1097 Oleander Avenue. RECOMMENDATION: That Council adopt resolution granting an additional time of 48 days from March 14 to May 1 to complete the work at 1097 Oleander. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Mr. Wheeler, 1097 Oleander Avenue, violated the Chula Vista Municipal Code by remodeling and adding an addition to the dwelling he occupied without first submitting plans and obtaining permits to do the construction. All notices to obtain permits were ignored, so on August 26, 1983, the City Attorney prepared a Notice of Hearing on Abatement of Public Nuisance. On September 13, 1983, Council adopted Resolution No. 11379 granting Mr. Wheeler six months to abate the nuisance. On September 15, 1983, Mr. Wheeler contacted then Director of Planning Bud Gray about obtaining a variance for the garage that is constructed in the required front setback. Later, Mr. Kevin Watson representing Mr. Wheeler stated that the garage would be torn down and permits obtained when Mr. Wheeler returned home. On February 28, 1984, Mr. George Ronis of the law firm of Ronis, Ronis & Ronis sent a letter to the Building Department requesting an extension of time to abate the nuisance as his client, Mr. Wheeler, had been incarcerated and would not be home until after April 6, 1984. I asked the City Attorney if I could grant an extension of time to abate the nuisance; he informed me that Council granted the six months, so any extension would have to be granted by Council . If compliance with the Chula Vista Municipal Code can be obtained by May 1 , 1984, the Building and Housing Department will have achieved their goal of abatement of the nuisance.
