Anthony and Esther D'Anchise, owners of the subject property have applied for
an encroachment permit to construct a wooden deck which would extend into the
City's open space lot approximately 8 feet. According to Section 17.08.450 of
the Chula Vista Municipal Code, this request must be considered by the City
Council.
RECOMMENDATION: That the Council approve the request for the encroachment
permit and authorize the City Engineer to issue same.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Mr. and Mrs. Anthony D' Anchise, owners of the property at 310 Surrey Drive
have had plans prepared for improvements to their property. These plans call
for the use of the area at the rear of the house as patio and deck in order to
take advantage of the view to the west. The patio would extend from the rear
of the house and extend out to an existing retaining wall located
approximately 10 feet from the house. A wooden deck, 10 by 17 feet in size,
is proposed to be built, extending from the retaining wall out over the
slope. The maximum encroachment is approximately 8 feet and the overall area
of the encroachment is approximately 150 square feet.
The Department of Parks and Recreation has reviewed the request. Upon a field
investigation, it was found that this proposed encroachment would not obstruct
the view of any of the neighboring residents or interfere with the purpose of
this open space. There is a concern, however, regarding the sprinkler line
running along the top of the slope. A condition of approval of the permit
would be that any relocation of the irrigation line would be the applicant's
responsibility.
Due to the vast area of this open space lot, the deck will not be obtrusive to
homeowners to the south of the open space. There is a natural canyon between
the properties.
Another condition, if approved, will be that the applicant obtain all other
permits as required by the City Code prior to construction of this deck.
