ITEM TITLE: Resolution //5'J Releasing a lien against the property
located on the east side of Ray Boulevard south of "E" Street.

A recent title search of the property on the east side of Bay Boulevard, south
of "E" Street, revealed the existence of a $9,500 lien against the property.
This property was formerly owned by Harding Campbell. In 1971 , Mr. Campbell
was granted a deferral of the requirement to install public improvements along
the frontage of his property. A lien was placed against the property to
guarantee the future installation of these improvements. Since that time, the
improvements have been constructed. The lien may now be released.
RECOMMENDATION: That the Council adopt the subject resolution and release
the lien.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
In 1970, the owner of the 3.5 acre parcel on the southeast corner of "E"
Street and Bay Boulevard, Mr. Harding C. Campbell , applied for a building
permit on the property. In accordance with the City Code, Mr. Campbell was
required to install public improvements on "E" Street and Bay Boulevard
frontages. He applied to the Planning Commission to have this requirement
deferred.
In February 1971 , the Planning Commission considered and approved the deferral
request. Mr. Campbell was required to enter into a deferral agreement with
the City and post a guarantee for the future installation of the
improvements. As a guarantee, he consented to a lien in the amount of
$9,500.00 being placed against the property. This deferral and lien agreement
was approved by adoption of Council Resolution No. 5961 on February 23, 1971 .
Since that time, the subject property has been redeveloped with the addition
of Anthony' s Restaurant, Days Inn Motor Hotel and El Torito Restaurant. All
the street improvements which were required to be installed in 1971 have been
completed. There is no longer a need to have the existing lien against the
property. (Properties affected: Assessor's Parcel Nos. 567-021-29,
567-021-38, and 567-021-37).
Adoption of the subject resolution will rescind nril Rocnlutinn Mn_
and release the lien.
