Prior to concreting the poles, the sign was found to be encroaching into the City's drainage easement. Mr. James F. McKenzie of Integrated Sign Associates has submitted a request to allow this encroachment. RECOMMENDATION: That the Council approve the subject encroachment and authorize the City Engineer to issue the permit. BOARDS/COMMISSIONS RECOMMENDATION: The signing for the shopping center was reviewed and approved by the Design Review Committee. DISCUSSION: Recently, the Design Review Committee approved a signing program for ADMA's Bonita Center East shopping center. A sign at each entrance to the center was proposed (one on Otay Lakes Road and the other on Bonita Road) . Two separate building permits were issued for the signs. The first was for the sign at the entrance on Otay Lakes Road, which was routed through this department for review. The second sign for the Bonita Road entrance was replacing a temporary sign already existing, so the building permit was not routed through the Engineering Department, at which time the encroachment would have been discovered. Consequently, the monument sign was mistakenly placed within the City's 22-foot wide sewer/drainage easement. As soon as the encroachment was discovered, the sign company, Integrated Sign Associates inquired about a permit to allow the sign to be permanently anchored in this location. It has been determined, after investigation, that the placement of this sign in the easement will have no adverse effect on the maintenance of the sewer or storm drain. Wordage in the permit provides the City power to have the encroachment removed by the owner in case it ever becomes necessary to excavate for repair or other needed maintenance. There are no other utilities located in this easement.
