On August 17, 1983, the City Planning Department received an application for a reorganization from Mr. Mitchell N. Angus, owner of a certain parcel of land located at the northwest corner of "C" Street and Del Mar Avenue. The proposed reorganization involves annexation to the City of Chula Vista and concurrent detachments from the San Diego County Flood District - Zone 3 and the Lower Sweetwater Fire Protection District. The proposal area is described in Exhibit A and depicted on Exhibit B of this report. The San Diego Local Agency Formation Commission adopted a resolution approving the subject reorganization proposal at their meeting of January 9, 1984, and authorized the Chula Vista City Council to initiate reorganization proceedings. RECOMMENDATION: That Council adopt a resolution ordering the proposed "Angus/Del Mar Reorganization" involving annexation to the City of Chula Vista and concurrent detachments from the San Diego County Flood Control District - Zone 3 and the Lower Sweetwater Fire Protection District. BOARDS/COMMISSIONS RECOMMENDATION: DISCUSSION: The proposal area, which is located at the northwest corner of "C" Street and Del Mar Avenue in the unincorporated territory of San Diego County, contains 1.76 acres of land, including the right-of-way of the adjoining streets directly adjacent to the applicant's property. Mr. Angus, applicant and property owner, has requested annexation to the City in order to obtain comprehensive municipal services for one existing single-family dwelling and a proposed affordable housing development. General Plan and Prezoning The subject property is currently unincorporated and is designated "Medium Residential (7.3 du/ac)" on the Land Use Element of the County General Plan. The property is presently County-zoned RV-15 (Residential Variable, 14.5 du/ac maximum density, 6,000 sq. ft. minimum lot size) . The Plan Diagram of the Land Use Element of the Chula Vista General Plan designates the parcel "Medium Density Residential (4-12 du/ac)" . Page 2, Item 8 Meeting Date2-28_84 On October 19, 1978, the City Council adopted Ordinance No. 1832 prezoning the unincorporated area in the northwest quadrant of the intersection of "C" Street and North Second Avenue to "R-1" (single-family residential zone, 7,000 sq. ft. minimum lot size) . The annexing parcel is contained within the R-1 "prezoned" area. Existing and Proposed Development The proposal area is presently occupied by a single-family dwelling, which is located at the easterly end of the property near Del Mar Avenue. The applicant has indicated that he intends to develop the property at a future date with a multiple-family residential project for low-income families. The applicant is cognizant of the fact that the "R-1" prezoning will officially apply to the subject property concurrent with annexation completion, and that the property's future development must be consistent with the zonal regulations of the "R-1" district, unless a rezoning application is approved by the City Council. Environmental Review In September 1983, the City's Environmental Review Coordinator reviewed a previous Initial Study (Negative Declaration IS-78-77) , which was prepared in conjunction with the above mentioned "R-1" prezoning case of October 1978. It was determined that environmental circumstances in the area of the proposed annexation have not changed significantly since 1978, and therefore, the findings contained in Negative Declaration, IS-78-77 are still applicable to the proposed annexation. LAFCO Action At a public hearing on January 9, 1984, LAFCO adopted a resolution approving the "Angus/Del Mar Reorganization" . By said resolution, LAFCO designated the City of Chula Vista as the "conducting authority" and authorized the City Council to initiate proceedings in compliance with LAFCO's resolution and without notice and hearing. Municipal Services The City's Public Works, Fire, and Police Departments have concurred that the subject reorganization area can be served immediately upon annexation without an increase of manpower and/or equipment. FISCAL IMPACT: The City of Chula Vista and the County of San Diego have adopted a Master Property Tax Exchange Agreement which pertains to this jurisdictional change. The City will receive property tax revenues from the subject territory in accordance with the agreement currentl in effect.
