McMillin Development recently applied for an encroachment permit to place a
permanent, monument-type identity sign in an open space lot. The lot is
located at the corner of Hidden Vista Drive and Smoky Circle in Hidden Vista
Village Subdivision, now known as Terra Nova. The Chula Vista Municipal Code
requires that encroachments such as this must be considered by the Council for
approval.
RECOMMENDATION: That the City Council approve the subject Encroachment
Permit PE031 and authorize the City Engineer to issue same.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
When the subdivision map of Hidden Vista Village was recorded, Lot No. 319 was
deeded to the City for a fire station site. The lot is located at the corner
of Hidden Vista Drive and Smoky Circle. Since that time, however, the fire
station site was relocated. Subsequently, the lot was subdivided into three
lots, two each for single family dwellings, and a third parcel being created
for open space use (Parcel 3 of Parcel Map No. 12836) . A resolution
quitclaiming Parcels 1 and 2 to McMillin was adopted at the February 7th
Council meeting.
As a part of its development, McMillin Development would like to construct a
permanent identity sign at the aforementioned corner. By letter dated
January 11, 1983, McMillin requested the issuance of an encroachment permit to
allow placement of the sign in the City' s open space lot. The proposed sign
is the monument type constructed with masonry materials.
The Departments of Planning and Parks and Recreation have reviewed the
request. There are no objections from either department. They are both in
favor of including the cost of maintaining the sign, if any, in the open space
maintenance district for this subdivision. I agree that this would be an
equitable means of spreading the maintenance costs among the homeowners of the
area.
The location of the sign is proposed to be 20 feet from the face of the curb
on Hidden Vista Drive. Therefore, there will be no sight distance problem.
There are no public utilities in this area to conflict with the placement of
the monument.
The encroachment permit contains wordage that holds the City harmless from
damages resulting from this encroachment. It also contains a statement
regarding maintenance and removal being the responsibility of the permittee or
his successors.
