Wylie Construction Company for the Town Centre Parking Structure from December 19, 1983, through January 16, 1984 SUBMITTED BY: Director of Building & Housi ::.'/5ths Vote: Yes No X ) REVIEWED BY: City Manager In a previous statement, Council was requested to grant C. E. Wylie an extension of time from the original contract date of November 30 to December 19, 1983. Subsequent to the granting of that request, the Council was then informed by memo via the City Manager that additional days should be granted the contractor for inclement weather to January 6, 1984. Unfortunately, more inclement weather has forced work stoppages at the project site. Within this time period, the heavy rains had caused muddy conditions that prohibited the finishing off of the service road and apron at the parking structure entrances. Those additional 'rain' days cause staff to recommend a contract extension to January 16, 1984. RECOMMENDATION: To approve the resolution granting an extension of contract time to C. E. Wylie Construction Company from December 19 to January 16, 1984. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Rain days delaying work on a public works construction project are allowable per the Standard Specifications for Public Works Construction, 1982 edition. The total time extension requested for inclement weather is 18 days not including the two holidays given by the labor unions for Christmas and New Years. Standard construction practices were employed in assessing the impact of the recent heavy rains experienced in November and December on the project. These were used in determining whether the roadways were suitably dry in preparation for constructing the concrete service road and apron driveways adjacent to the parking structure. Without a dry base material , it was feared that the concrete would be laid on an unstable, muddy and wet base and, consequently, crack and spread apart; thus, causing future maintenance problems. Prior to the contract expiration date of December 19, 1983, additional rain on November 13 created wet and muddy site conditions so that no grading or placing of concrete could take place on November 14, 15, and 16. Again, rain Page 2, Item 12 Meeting Date 1/1034 on November 21 , 22, and 23, and muddy and wet site conditions on November 25 stopped the site grading and placing of concrete. There was a total of 7 days during November that site work and placing of concrete could not be accomplished. On December 24, 25, 26, and 27 exceptional rainy weather created wet and muddy site conditions where no site grading, placement of concrete, or underground plumbing could be done. A total of 11 days in December and January were not worked due to extremely wet, muddy site conditions. A total of 18 days should be granted to the contractor due to inclement weather. The net effect in granting an extension of contract time is to not employ the liquidated damages clause of the construction contract until the 17th of January. The penalty rate is $1 ,000 per day. Mr. Gingerich will no longer be needed beyond the finishing of the concrete work at the service road and driveway aprons. Hence, he has been notified that the termination date of his contract is January 17. City staff inspectors will then attend to those duties in inspecting finish work on the structure.
