Adoption of this resolution would allow Foster & Kleiser, Gannett
Outdoor and Metromedia, Inc. to erect two billboards to replace
the 19 that were torn down by MTDB after it took over the right of
way from the Arizona & Eastern Railway. This would enable MTDB to
settle a lawsuit brought by the billboard companies against it.
RECOMMENDATION: Adopt the Resolution

DISCUSSION:
MTDB removed 40 sign structures without compensation to the sign
companies during construction of the trolley. 19 of those struc-
tures were within the City of Chula Vista. The sign companies
sued for inverse condemnation claiming damages in excess of $1
million dollars. MTDB and the billboard companies entered into a
proposed settlement which requires MTDB to replace a minimum of
three structures and a maximum of six. MTDB is to pay $35, 000 for
the fourth, fifth and sixth sign if not constructed.
In order to implement the settlement, MTDB has requested Chula
Vista to permit two signs within the City. National City has
approved one sign on December 6, 1983 . If this approval is not
obtained, MTDB would stand to lose over $1 million dollars in
damages.
MTDB will use the rent received for the signs for trolley mainte-
nance and improvements within the City of Chula Vista. This will
amount to $8, 200 per year. The signs shall be constructed
pursuant to a lease with a term of fifteen years. At the
conclusion of the fifteen years, the signs have to be removed
unless an extension were to be approved. This settlement would be
in the public interest in that the large amount of damages that
could be awarded in this case might have a significant impact upon
MTDB ' s service to the public.
The specific location of the signs will be subject to staff
approval and will be a minimum of 450 feet north of "E" Street to
protect the appearance of this entry point to the City of Chula
Vista.
