and Operation Agreement

After many months of effort by representatives of the City of San Diego, Otay
Water Distsrict (OWD) , Otay International Center (OIC) , Montgomery Sanitation
District (MSD) and Chula Vista, a complex interagency agreement has been
prepared which would allow Otay International Center to temporarily connect to
and make use of the Date/Faivre Sewer (which is operated jointly by MSD and
Chula Vista) .
RECOMMENDATION: That Council adopt the resolution approving the agreement,
authorizing the Mayor to execute the agreement and certifying that Council has
reviewed and considered Otay International Center EIR (San Diego EQD No.
83-0748) and the Adequate Prior Environmental Review document on file with the
City Clerk.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Otay International Center is situated on Otay Mesa adjacent to the new
international border crossing. It is proposed that a sewer line be
constructed from the Center to the easterly end of the Date/Faivre sewer on
the vicinity of Palm Avenue. The new line would be connected to Date/Faivre
at that point and during the initial phase of this agreement, OIC/San Diego
would be permitted to make use of currently unused capacity in that line.
The agreement provides a reserve of 650,000 gallons per day for Chula Vista to
accommodate growth during the period of multi-agency use of the Date/Faivre
sewer.
Prior to making the connection to Date/Faivre, OIC/San Diego is required to
enlarge a currently overloaded segment of Date/Faivre in Industrial
Boulevard. Such work will be at no expense to Chula Vista or MSD.
As combined peak flows approach the design capacity of any segment of
Date/Faivre, then OIC/San Diego will be required to construct the appropriate
segment of a new sewer paralleling Date/Faivre. An option to phased
construction of the parallel line is to undertake construction of the total
parallel line as a single contract.

Once the total parallel line has been completed (whether through phased
construction or single contract) then the OIC/San Diego flow will be removed
entirely from Date/Faivre and will be carried in the parallel line. Likewise,
any MSD/Chula Vista flow which may have been temporarily routed via a segment
of the parallel line would be redirected through Date/Faivre.
No specific termination date is provided. Termination of the agreement is,
instead, based on total flow versus pipe design capacity. Neither does this
agreement specify fees for transportation and capacity rental during the
temporary period of multi-agency use of Date/Faivre. Such fees are to be
established in separate agreement to be approved by Chula Vista, San Diego and
MSD prior to discharge into Date/Faivre by OIC/San Diego.
The 650,000 gallon per day capacity reservation for Chula Vista provided in
the agreement is considered amply adequate for vigorous growth of the City in
the Otay Valley gravity basin.
Among the direct benefits the City will receive through this agreement are:
1) relief from sharing in cost to construct a relief to an overloaded segment
of existing Date/Faivre, and 2) sharing fees for transportation and capacity
rental . The value of the first item is estimated to be in the range of
$50,000. No estimate of the value of fees to be collected has been made.
In return for the above benefits, Chula Vista accepts a "limit" upon its
growth in sewage generation in the Otay Valley during the temporary period of
multi-agency use of the Date/Faivre line.
FISCAL IMPACT: Eliminates need for City to share with MSD in cost of
enlarging overloaded segment of Date/Faivre.
Probable small income from fees to be collected for transportation and
capacity rental from San Diego.
