On November 22, 1983, Council set December 13, 1983, as the date for a public hearing on the proposed formation of Open Space Maintenance District No. 11. RECOMMENDATION: That Council: 1. Conduct the public hearing. 2. Adopt a resolution forming Open Space Maintenance District No. 11 for Hidden Vista Village (Terra Nova) . 3. Adopt a resolution accepting grant deeds for additional open space lots S, T and Parcels 1 and 3 of Parcel Map 13006. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: As conditions of approval of the Tentative Map for Hidden Vista Village (Terra Nova) the developer was required to petition for the formation of an open space maintenance district. Those conditions have been met. The boundary for proposed Open Space Maintenance District No. 11 is the same as that for Hidden Vista Village Subdivision as shown on Map No. 10051 plus an adjacent 2.05-acre parcel (592-100-46) on the west. Attachment "A" shows the proposed boundary. & 7 7 7 I - - Page 2, Item 7, a.b Meeting Date 12/13/$3 The owner will install the necessary landscaping and irrigation at no expense to the City. The landscaping will be complete and established by the petitioner prior to acceptance by the City on behalf of the proposed open space maintenance district. There are 955 benefiting properties (1,328.6 EDU) on the assessment rolls within the proposed district, and the estimated annual maintenance cost to be assessed each EDU is approximately $75. The annual assessment will be approximately $75 for a single family home or condominium, $37.50 for an apartment and $640 for a commerical acre. Attachment B indicates the allocation of costs for each lot within the district. Lot numbers are those shown on Map 10051, Hidden Vista Village and Parcel Map 13006. Total annual maintenance costs are estimated at $100,000 per year (see Attachment C) . City Council by Resolutions 10946, 11433 and 11434 have accepted title to Lots "A", "E", "F", "G", "H", "J", "K", "P", "V" and "W". These lots are all included within the District. Parcel 3 of Parcel Map 12836 is a City owned lot created when the former fire station (lot 319) was divided. That lot will also be included in the district since it is a highly visible slope along Hidden Vista Drive. On December 2, 1983, the developer granted lots S and T of Map 10051 and Parcels 1 and 3 of Parcel Map 13006 (portions of former Lot "U") to the City by grant deed. These lots were offered for dedication on Map 10051 and were rejected. Council may now accept the lots so that these highly visible areas can be included in the Open Space District. The petitioner is the present owner of all the assessed properties except those owned by the City. The responsibility for paying the open space maintenance assessment will be conveyed with each of the benefiting properties as those properties are sold. The open space areas and the benefiting properties are as shown on the map of the proposed district (Attachment A) . At the City Council meeting of November 22, Council requested that staff submit a report answering four questions relative to the district. Those concerns are discussed in Attachment "D". Attachment "E" shows the developers anticipated schedule for formation of the district, all planting and installation, and acceptance by the City for maintenance work in June 1985.
