The purpose of this report is to provide the necessary background information
to enable Council to initiate formation of an open space maintenance district
within Hidden Vista Village. The boundaries of the proposed district are
shown in Attachment A. It is contemplated that the open space areas adjacent
to the condominium developments within Hidden Vista will be maintained by
their respective homeowners association. Specific issues examined in this
report are the requirement for the proposed district and conformance, by the
petitioner, with the criteria contained in the Municipal Code for establishing
open space maintenance districts.
RECOMMENDATION: That the City Council :
1. Adopt a resolution declaring the Council' s intention to form the proposed
district in accordance with Section 17.08. 160 of the Municipal Code.
2. Set December 13, 1983, at 7:00 p.m. in the Council Chambers as the date
and time for a public hearing to consider the proposed formation of Open
Space Maintenance District No. 11.
3. Direct the City Clerk to advertise the public hearing and mail notices of
the hearing to affected persons in accordance with Sections 17.08. 180 and
17.08.190 of the Municipal Code and the notification requirement of the
laws of the State of California.

DISCUSSION:
McMillin Development, Inc. , managers of Hidden Vista Village (Terra Nova) for
the owner, Financial Scene, Inc. , submitted a letter of petition on August 4,
1981, requesting formation of an open space maintenance district. The
petition complies with conditions 6 and 56 contained in Resolution 10081A
approving the Tentative Map of Chula Vista Tract 80-15, Hidden Vista Village.

The owner has dedicated and the City Council by Resolutions 10946, 11433 and
11434, has accepted title to twelve lots designated as open space on the Final
Map of Chula Vista Tract 80-15, Hidden Vista Village. Six lots (A, E, F, G,
V, W) will be maintained as natural open space. The remaining six lots (H, J,
K, P and parcels 1 and 3 of Lot U) are landscaped slopes. By Resolution 11432
on November 1, 1983, Council approved the adjustment of a boundary between Lot
Q and Lot H to include the highly visible open space along Ridgeback Road in
that district. Similarly, the owner intends to grant parcels 1 and 3 of Lot U
to the City because both lots are highly visible landscaped open space along
East "H" Street and Hidden Vista Drive. The proposed open space district also
includes the East "H" Street median within Hidden Vista (Terra Nova).
All of these open space lots conform to the criteria contained in Section
17.08.020C of the Municipal Code. None of these 12 lots will be maintained by
a homeowners association.
The owner will install the necessary landscaping and irrigation at no expense
to the City. The landscaping will be complete and established by the
petitioner prior to acceptance by the City on behalf of the proposed open
space maintenance district. There are 955 benefiting properties (1 ,328.6 EDU)
on the assessment rolls within the proposed district, and the estimated annual
maintenance cost to be assessed each EDU is approximately $75. The annual
assessment will be approximately $75 for a single family home or condominium,
$37.50 for an apartment and $640 for a commerical acre. Attachment B
indicates the allocation of costs for each lot within the district. Lot
numbers are those shown on Map 10051, Hidden Vista Village. Total annual
maintenance costs are estimated at $100,000 per year (see Attachment C) .
The petitioner is the present owner of all the assessed properties. The
responsibility for paying the open space maintenance assessment will be
conveyed with each of the benefiting properties as those properties are sold.
A cost analysis and map showing the proposed district, the open space areas
and the benefiting properties is attached.
