On November 6, 1981 , by Resolution 10665, Council approved an amendment to
Condition 17 of Resolution 10276. A wording revision is now before Council
for approval.
RECOMMENDATION: That Council adopt the resolution.

DISCUSSION:
On October 31 , 1981, Council approved the Final Map for Chula Vista Tract
80-20 Unit 1 (Charter Point) .
Based upon an agreement between the Gersten Companies and the City approved
five years ago, the City allowed development of Charter Point subject to
construction of offset improvements on Telegraph Canyon Road. Five years ago
traffic volumes on Telegraph Canyon Road were 16,790 vehicles per day
(approaching capacity for a two lane road) . That is the reason for the
extraordinary condition.
By Resolution 10665 Council revised Condition 17 of PCS 80-20 to read as
follows:
"17. Prior to occupancy of any residences in either Unit II or Unit III,
A paraphrase of the actual condition states that the developer p is required to
construct Telegraph Canyon Road between Charter Point and the existing widened
section (easterly of Paseo Ladero) four lanes wide on a temporary alignment.
The condition as written above allowed 104 residential units (total number of
dwelling units in Phase I) to be occupied prior to completion of Telegraph
Canyon Road. Subsequent to the adoption of said condition of approval the
traffic volume on Telegraph Canyon Road have fallen to 13,400 in September of
this year. The reduction has occurred because 1) East "H" Street has been
constructed and 2) traffic volumes on Bonita Road have increased.

The developers have requested that the wording of the condition be changed to
provide occupancy of 104 units prior to construction of the roadway without
designating the unit from which the dwellings can be located. To accomplish
the developer's objective, the beginning of the first sentence would read:
"Prior to occupancy of more than 104 units. .."
Since 1) Charter Point has a total of 274 units, i.e. 170 left to develop; 2)
traffic on Telegraph Canyon Road has dropped significantly over the last few
years; and 3) we have a bond for the construction of the offsite improvements
in the amount of $1 .6 million, staff believes the change will have no impact
upon the City but will give the developer flexibility and, therefore,
recommends its approval.
The remainder of the condition of approval would remain the same. Thus, the
wording change would do nothing more than provide Pacific Scene with
flexibility with respect to occupancy of units within the entire subdivision.
In recent months City staff have been discussing with the Gersten Companies,
EastLake, Pacific Scene, and United Enterprises a proposal to change Pacific
Scene's requirement to construct Telegraph Canyon Road. Those discussions
have been relative to constructing less offsite improvements (which would be
removed in the future) to construction of onsite improvements which would be
permanent.
Once an agreement is reached, we will return to Council with a new proposal
for Pacific Scene's construction responsibility of Telegraph Canyon Road.
