HomeMy WebLinkAboutAgenda Statement 1983/10/18 Item 7 COUNCIL AGENDA STATEMENT Item 7 _ Meeting Date 10/18/83 ITEM TITLE: Resolution //'/O Z Accepting petition for the construction of missing sidewalk in Millan Court east of First Avenue SUBMITTED BY: City Engineer (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager The City Engineer has received a petition from property owners in Millan Court east of First Avenue requesting that 1911 Block Act proceedings be commenced for construction of missing sidewalk in this block. The petition subsequently was filed with the City Clerk on October 3, 1983. RECOMMENDATION: That Council direct staff to contact the property owner of missing sidewalk for voluntary installation of sidewalk. If property owner doesn' t volunteer, staff to consider as part of the 1984-85 Block Act Program. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Mr. Otto, a resident of 83 Millan Court, recently contacted the Engineering Department in regard to the construction of missing sidewalk fronting the lot on the northeast corner of Millan Court and First Avenue. He and his neighbors who live in the cul-de-sac already have sidewalk and would like to see these improvements installed. We prepared a petition which he subsequently circulated among the residents of Millan Court east of First Avenue. The petition was signed by nearly all the residents within the cul-de-sac. The petition requested that proceedings be commenced for the construction of missing sidewalk in Millan Court east of First Avenue in accordance with Chapter 27 of the Street and Highway Code of the State of California. A copy of this petition is attached. We have not previously considered this a priority project because sidewalk exists on the south side of the street in Millan Court. Also, the lot is unimproved where the sidewalk is required. In accordance with Chapter 27, the City may require the property owner at the northeast corner of First and Millan to install the missing sidewalk. However, at this time, we believe it appropriate to direct staff to include this project for consideration in the CIP Block Act Project for 1984-85. FISCAL IMPACT: None.
