After receiving this report, Council directed staff to prepare amendments to the garage sale ordinance clarifying the period during which a garage sale may be held and providing for an increased license fee for people who fail to obtain the license in a timely manner. RECOMMENDATION: Adopt the ordinance amending Chapter 5.32 of the Chula Vista Municipal Code to allow for two garage sales per year which may run for ten consecutive days and providing for a $3.00 license fee when licensed in the field. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The purpose of the garage sale ordinance, as stated in Section 5.32.010 of the Chula Vista Municipal Code, is to allow homeowners to dispose of unwanted or surplus household furnishings or other personal property while at the same time preventing the expansion of commercial operations into the R-1 zone and unfair competition with licensed revenue producing commercial and business enterprises. The definition of garage sales at Section 5.32.010 of the Code includes sales of household furnishings and other personalty conducted on "any portion of the premises" and is not limited to sales conducted strictly in a garage. It also includes sales conducted by a combination of residential dwellers at a single location and rummage sales or fundraising events for civic and charitable purposes. There has been some concern over whether our definitions need clarification, but I don't think this is necessary. Regardless of what name is applied to the sale of household goods and personal property in the R-1 zone, it is the activity which is regulated and it will fall under the definition of a garage sale. The ordinance presently limits the period of the sale to ten days. People naturally prefer to conduct these sales on weekends and there is the danger that they will interpret this section to allow them to permit the sale on five Page 2, Item / 7 Meeting Date 9/20/83 consecutive weekends, each one counting as two days. The amendment would clarify the limitation by stating that the ten days are consecutive so that the sale could not extend beyond two interconnected weekends. In addition, the amendment would provide for a $5.00 license fee when the license was not obtained prior to the garage sale. This provision would encourage people to get their license in a timely manner consistent with the City Code and receive their license for $2.00. When the amendments to the garage sale ordinance are approved, a notice will be included in the Chula Vista Sanitary Service billings notifying residents of all requirements of the ordinance and information will also be provided to the local press. The recommended changes in the ordinance will not be enforced until 30 days after notification to all residents in the City. Finally, the amendment would do away with the definition of "identifiable goods." It is difficult to understand why we chose to define this term when it is not used anywhere within the ordinance.
