HomeMy WebLinkAboutAgenda Statement 1983/09/27 Item 12 COUNCIL AGENDA STATEMENT Item 12 Meeting Date 9/27/83 ITEM TITLE: Resolution //3” Approving Encroachment Permit No. PE022 at 361 Wagonwheel Way fl/ SUBMITTED BY: City Engineer (4/5ths Vote: Yes No X ) REVIEWED BY: City Manager The owners of the property at 361 Wagonwheel Way recently applied for an encroachment permit to place a cantilevered deck into the City's open space lot adjacent to their property. This type of encroachment is not within the realm of those which maybe approved by the City Engineer; therefore, it must be considered by the City Council . RECOMMENDATION: That Council approve the permit subject to the listed conditions and authorize the City Engineer to issue same. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Mr. and Mrs. Jesus Blanco propose to install a swimming pool in their rear/side yard. As an integral part of the pool , they intend to build a cantilevered, wooden deck along one edge of the pool . This deck extends out, over the City' s Open Space Lot No. 244 of Rancho Robinhood III. The maximum encroachment is 5-1/2 feet with a length of about 40 feet. This represents a total area of approximately 176 square feet. The plan submitted to this department shows a portion of the deck to be above the existing slope with the remainder over a regraded area. It will be supported on a continuous footing within private property. There will be no permanent structures embedded in the ground within the open space. The Department of Parks and Recreation staff has reviewed the plans. Except for the possible need to relocate a temporary irrigation line, they have no objection to the encroachment. This irrigation line is for the City's open space but is evidently on private property. The City Landscape Architect also has reviewed the proposal and has no objections. The proposed encroachment will not obstruct the view of any of the neighbors. It will not hamper the maintenance of the open space. Page 2, Item 12 Meeting Date 9/27/83 If the encroachment permit is approved, the following conditions should be added: 1 . The temporary irrigation line shall be relocated outside the encroachment area. 2. Any damaged landscaping within the open space shall be restored to original condition by the owner. 3. Any grading taking place within the open space shall be shown on the building plans for the deck. Due to the fact that this encroachment is minor in nature, it is recommended that the Council approve the request with the above mentioned conditions and authorize the City Engineer to issue the encroachment permit.
