APPROVING AGREEMENT FOR THE CONSTRUCTION OF IMPROVEMENTS IN GUAVA MANOR THE CITY COUNCIL OF THE CITY OF CHULA VISTA , DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That certain agreement between• ROBERT A. MILES, LOUISE H. MILES, husband and wife, MYRON J. DALSETH and BETTY M. DALSETH, husband and wife, and the CITY OF CHULA VISTA, a municipal corporation, dated February 20th, 1950, a copy of which is attached hereto, and incorporated herein, the same as though fully set forth herein, be, and the same is, hereby approved. SECTION 2. That LORENZ C. KOESTER, Mayor of the City of Chula Vista, be, and' he is hereby, authorized and directed to execute the same for and upon behalf of the said City upon the posting of the bonds by ROBERT 'A. MILES, LOUISE H. MILES, MYRON J. DALSETH and BETTY M. DALSETH, as provided for in said agreement. ADOPTED, SIGNED AND APPROVED this 21st day of February,1950. MILES,- LOUISE H. • ' MILES, husband and wife, and MYRON J. DALSETH and BETTY M. DALSETH, husband and wife, hereinafter called "Second Party", as, follows: WITNESSETH: WHEREAS the Second Party is the owner of the following • described real property in the City of Chula Vista, County of San Diego, State of California: The Easterly Half of Lots 11 and 12 in Quarter Section 150 of Chula Vista, according to the Map thereof No. 505, filed in the office of the County Recorder of said San Diego County, March 13, 1$8$. • EXCEPTING from said lot the Easterly 1$7 feet thereof. ALSO EXCEPTING from said East Half of Lot 11 the Southerly 219 feet of the Westerly 279 feet thereof. WHEREAS the Second party proposes to create a subdivision • " : of said above-described property to be.known as GUAVA MANOR, • and to effect the same has filed with the proper authorities of the City of Chula Vista the necessary maps and improvement plans and other data in conformity with the laws of the State • • of California and the Ordinances of the City of Chula Vista; and • • WHEREAS the proper authorities of said City have found the proposed subdivision plan to be acceptable; and WHEREAS the City of'Chula Vista is entitled to require from the Second Party, and does require from Second Party, as a condition precedent to the acceptance of any and all streets, easements and other improvements, assurances for the completion of the public improvements in said subdivision as is provided therefor in said plans and attendant specifications as have • heretofore been approved as aforesaid; and WHEREAS the Second Party is willing to supply such assurances; NOW, THEREFORE, IT IS HEREBY AGREED BY and between the City of Chula Vista and said Second Party as follows: 1. Said Second Party agrees to undertake and complete and to pay for all labor and materials in connection therewith, within a period of 365 days from the date hereof all the necessary work and installation of improvements in the here- inabove described subdivision in full conformity with the ordi- nances of the City of Chula Vista, the laws of the State of California and the directions of proper officials of the City • of Chula Vista, California as may be applicable thereto. Said improvements are more particularly described as follows: Improvements Unit Cost Estimated Cost Oil Surfacing including ex- cavation,D.G., compaction and spreading,28,100 sq. ft. @10¢ $ 2,$10.00 Sewer 8" in place, 720 lin. ft. @3.00 2,160.00 Conc. precast manholes,2 @ $175.00 350.00 Conc. Sidewalks, 4' P.C. , 17$0 lin. ft. @ 01.00 1,7$0.00 Curb and Gutter, 2300 lin.ft. , @ $1.50 3,450.00 Dead Ends 70.00 TOTAL $11,133.00 • The Second Party further agrees to indemnify, protect and hold harmless the said City of Chula Vista from any and all claims of liability for personal injuries or property damage or for • • claims of labor or material men which may be made against said • City by reason of said work and installation of improvements as herein provided. 2. As a guarantee and as security for its full and faith- ful performance in complying with all the requirements for the completion of said subdivision as aforesaid, the said Second Party shall deliver to the said City of Chula Vista, upon the -2- • execution of this agreement, a good and sufficient bond executed by an authorized surety company satisfactory to the said City of Chula Vista in the sum of ELEVEN THOUSAND DOLLARS ($11,000.00) . 3• As a guarantee and as security for the payment of all labor and material claims for the completion of all said im- provements, the second party shall deliver to the said City of Chula Vista a bond in the sum of FIVE THOUSAND, FIVE HUNDRED DOLLARS ($5,500.00) , by its terms made to inure to the benefit of laborers and materialmen for labor and material performed or furnished in the performance of this agreement. 4. Upon the execution by Second Party of this contract • and the posting of the bonds as herein provided, the city • agrees to approve the Final Map of said subdivision and accept the same for recordation.
