HomeMy WebLinkAboutReso 1950-1096 ■ o o RESOLUTION NO. 1096 RESOLUTION OF THE CITY COUNCIL APPROVING AGREEMENT FOR THE CONSTRUCTION OF IMPROVEMENTS IN CLAIREVISTA UNIT C THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That certain agreement between CARLOS J. TAVARES and CLAIRE TAVARES, husband and wife, and the CITY OF CHULA VISTA, a municipal corporation, dated February 20th, 1950, a copy of which is attached hereto, and incorporated herein, the same as though fully set forth herein, be, and the same- is, hereby approved. SECTION 2. That LORENZ C. KOESTER, Mayor of the City of Chula Vista, be, and he is hereby, authorized and directed to execute the same for and upon behalf of the said City upon the posting of the bonds by CARLOS J. City Clerk of the it/ of Chula Vista, Califor a. • • CONTRACT_ FOR COMPLETION OF SUBDIVISION IMPROVEMENTS • IT IS HEREBY AGREED by and between the CITY OF CHULA VISTA, a municipal corporation and a political subdivision of the State of California, hereinafter called "City", and CARLOS J. TAVARES and CLAIRE TAVARES, husband and wife, here- inafter called "Second Party" as follows: WITNESSETH: • WHEREAS Second Party is the owner of real property in • the City of Chula Vista, County of San Diego, State of California • described in Appendix "A", attached hereto and by this reference • incorporated herein; and WHEREAS Second Party proposes to create a subdivision of the property described in Appendix "A", to be known as CLAIREVISTA • UNIT C and to effect the same has heretofore filed with the proper authorities of the said City the necessary maps and im- • • provement •plans and other data in conformity with the laws of the State of California and the Ordinances of the City of Chula • Vista applicable thereto; and WHEREAS the said proper authorities of said City have found the proposed subdivision plan to be acceptable and in accordance with the best interests of said City; and • WHEREAS the City of Chula Vista is entitled to require from Second Party, and does require from Second Party, as a condition precedent to the acceptance of any and all streets and easements, assurances for the completion of the, public improvements in said • subdivision as is provided therefor in said plans and attendant specifications as have heretofore been approved as aforesaid; and WHEREAS said Second Party is desirous of supplying such • assurances; and -1- Ob ) -'c c • • • • WHEREAS Second Party is also desirous of completing the installation of the public improvements in said subdivision in two (2) sections hereinafter designated as "Section ltt of Clairevista Unit C and "Section 2" of Clairevista Unit C. "Section 1" being described in Appendix "B", attached hereto • • and by this reference incorporated herein, and "Section 2", being described in Appendix "C", attached hereto and by this reference incorporated herein; • NOW, THEREFORE, IT IS HEREBY AGREED BY and between said • City of Chula Vista and said Second Party as follows: '1. Said Second Party hereby agrees to undertake and complete • and pay for, within a period of 365 days from the date hereof all the necessary work and installation of improvements in said Section 1 of the hereinafter described subdivision in full conformity with the ordinances of the City of Chula Vista, the laws of the State of California and the directions of proper officials of the City of Chula Vista, California as may be applicable thereto and in strict conformity with the plans and • specifications therefor attached hereto. As a guarantee and as security for its full and faithful • performance in complying with all the requirements for the • completion of the improvements in said Section 1 of said sub- division as aforesaid, the Second Party shall deliver to the said • City of Chula Vista, upon the execution of this agreement, a good and sufficient bond executed by an authorized surety company • satisfactory to the City of Chula Vista in the sum of EIGHTY- -3- ,. • • • FIVE THOUSAND, SEVEN HUNDRED AND FORTY and 00/100 ($85,740.00) • DOLLARS, and shall also deliver to the said City of Chula Vista as a guarantee and as security for its full and faithful per- formance in complying with all the requirements for the completion of the improvements in said Section 2 of said subdivision as aforesaid, the said Second Party shall also deliver to the said City of Chula Vista, upon the execution of this agreement, a good and sufficient bond executed by an authorized surety company satisfactory to the said City of Chula Vista in the sum of THIRTY-NINE THOUSAND, EIGHT HUNDRED and 00/100 DOLLARS (09,$00.00) . 3. As a guarantee and as security for the payment of all labor and material claims for the completion of all of said improvements, in said Section 1 of said subdivision as afore- said, the Second Party shall deliver to the said City of Chula Vista a bond in the sum of FORTY-TWO THOUSAND, EIGHT HUNDRED • AND SEVENTY and 00/100 DOLLARS ($42,$70.00) , by its terms made to inure to the benefit of laborers and materialmen for labor and material performed or furnished in the performance of that • portion of the work to be done in said Section 1 under this agreement and also as a guarantee and as security for the payment of all labor and material claims for the completion of all of • said improvements in said Section 2 of said subdivision as aforesaid, the Second Party shall deliver to the said City of Chula Vista a bond in the sum of NINETEEN THOUSAND, NINE HUNDRED and 00/100 DOLLARS ($19,900.00) , by its terms made to inure to the benefit of laborers and materialmen for labor and material . performed. or furnished in the performance of that portion of the work to be done in said Section 2. 4. Upon the execution by Second Party of this contract • • and the posting of the bonds as herein provided, the City agrees to approve the Final Map of said subdivision and accept the same • • for recording. • • -4- • 5• Upon the completion of the improvements to be installed in said Section 1 and the acceptance of said im- provements by the City of Chula Vista in accordance with the terms and conditions herein said City of 6hula Vista agrees to release the bonds furnished by said Second Party guaranteeing • the installation of the improvements in said Section 1 and upon the completion of the improvements to be installed in said Section 2 and the acceptance of said improvements by the City of Chula Vista in accordance with the terms and con- ditions herein said City of Chula Vista agrees to release the • bonds furnished by said Second Party guaranteeing the installa- tion of the improvements in said Section 2.
