RESOLUTION NO. 1075
RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CHULA VISTA ACCEPT-
ING DEDICATION OF AN EASEMENT IN
REAL PROPERTY TO THE SAID CITY.
THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY
RESOLVE AS FOLLOWS:
That certain dedication of an easement in real property
for sewer purposes executed by WILLIAM E. NORMAN and VIVIAN
A. NORMAN to the CITY OF CHULA VISTA, dated the 14th day of
November, 1949, a copy of which is attached hereto and hereby
made a part hereof the same as though fully set forth herein,
be, and the same is, hereby accepted by the said City of Chula
Vista.
ADOPTED, SIGNED AND APPROVED this 15th day of November,
1949.

WE, WILLIAM E. NORMAN and VIVIAN A. NORMAN, husband
and wife, as joint tenants, whose address is 524. East 7th
Street, National City, California, for and in consideration
• of the sum of ONE DOLLAR ($1.00) do hereby grant to the

• City of Chula Vista, County of San Diego, State of Calif-

ornia, an easement for the installation, construction and
maintenance of a sewer pipe or pipe lines, manholes and all
structures incidental thereto across and over the following
described property:

An easement more particularly described as follows:
Beginning at the Southeast corner of Lot 21,
Quarter Section 137 of Chula Vista, county of San
Diego, State of California, according to Map No
505, said corner being also the point of intersection
of Cypress Street and 2nd Avenue, thence North 18
degrees 28' West along the East line of Lot 21, 130.00
feet, thence South .71 degrees 22' 15" West 1$0.00 •

feet to the true point of beginning "A", thence North
18 degrees 28' West 200.115 feet along the center
line of an 8 foot easement to the North line of Lot 21.
An easement more particularly described as follows:
Beginning.-at the Southeast corner of Lot 21,
Quarter Section 137 of Chula Vista, County of San
Diego, State of California, according to Map No.
505, said corner being also the point of intersection
of Cypress Street and 2nd avenue, thence North 18
• degrees 28' West along the East line of Lot 21, 130.00
feet, thence South 71 degrees 22' 15" West 180.00
foot, thence North 18 degrees 28' West, 150.07 feet
to the true point of beginning "B, thence South 71
degrees 22' 15" West 126.22 feet along the center
line of an 8 foot easement to the East line of Twin
Oaks Avenue.
Such easement does not withhold from the Grantor the right
at his own risk to use the surface of the right of way hereby
granted, -for agricultural uses except for the planting and grow-
ing of trees, shrubs and bushes, the right to fence with gates
so as not to restrict entry by the City of Chula Vista and

the right to cross or make use of the surface in a manner not
detrimental to the installation, construction, operation, repair
•
maintenance and replacement of a pipe or pipe lines, or to any
other purposes and uses as are or may be necessary or incidental

• to the construction, maintenance and operation of the Chula
Vista City pipe line or pipe lines.
And the Grantor hereby agrees for himself, his successors

or assigns, that he will not construct or maintain or cause to
be constructed or maintained any buildings or structures of any
nature or kind that will interfere with the right of ingress
or egress along the pipe line by the Chula Vista City or its

representatives for the purposes of constructing, reconstruct-
.
ing, operating and repairing of said pipe line or pipe lines,
or otherwise interfere with said rights of ingress or egress.
And the Grantee hereby agrees not to fence the property,
nor to prevent Grantor's crossing over the right of way, and
agrees that the Grantor may enjoy the continued surface use of
the land herein described, subject to the conditions above
stated; and the Grantee agrees, after the installation of the
pipe line, to restore the surface grade above the pipe to as
near the original elevation as practicable.
