RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA AUTHORIZING A REQUEST
TO 'THE JUDICIAL COUNCIL OF THE STATE OF
CALIFORNIA FOR THE ASSIGNMENT OF LOWELL
HOWE TO SIT IN THE CITY COURT OF THE CITY
OF CHULA VISTA
THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1: That Lorenz C. Koester, mayor of the City "
of Chula Vista, be, and he is, hereby authorized to sign
and foreward to the Judicial Council of the State of Calif-
ornia that certain letter, a copy of which is attached here-
to, and by this reference made a part hereof.
SECTION 2: That in the event the Judicial Council of •
the State of California shall assign Lowell Howe to sit and
hold court in the City Court of the City of Chula Vista,
his salary shall be $250.00 per month.

Re: Assignment or Justice -of Peace to
Sit in the City Court of Chula Vista
Dear Sirs: ,
For and on behalf of the City of Chula Vista, California,
request is hereby made that Mr. Lower Ho-.4e, Justice of the
' Peace of National Township, San Diego County, be assigned to
sit and hold Court in the City Court of Chula Vista, a court
in which a vacancy Will exist on September 1st, 1949 by reason
of the compulsory, retirement of the incumbent. It is requested
that this assighnient be made effective on or shortly after
September 1st, 1949 and 'continue until the vacancy is filled
by a permanent appointment. It is believed that the two,
positions can be handled by one Judge without grave difficulty
and as authorized by the Municipal Corporation Act, Section $83.
" It is my belief that this assignment will be for the best
interest of the City of Chula Vista and will not interfere
with the administration of judtice in the Justice's Court of
National Township. This letter has been authorized by the City
Council of the City of Chula` 7'ista by its Resolution No. 146 ,"
dated August 23rd, 1949. €' ion. -
Mr. Lowell Howe has indicated to me that the assignment,
if made by you, will have his approval and full cooperation.

Dear Mayor Koester:
This will acknowledge receipt of your let-
ter of August. 24.6h concerning a vacancy which will occur
on September 1st in the office of City Judge of Chula
Vista.
Article VI, Section la (6) of the Constitu-
tion provides for the assignment by the Chairman of the
Judicial Council of a "judge to another court of like or
higher jurisdiction." As the Justice's Court of National
Township exercises Class "A" jurisdiction, this precludes
the assignment of Judge- Lowell Howe to the City Court of
Chula Vista inasmuch as the latter court exercises Class
"B" jurisdiction.
I am sure that Chief Justice Gibson, as
Chairman of the Judicial Council, will be glad to assign
a judge from any court wf th Class "B" jurisdiction that
you may suggest, and we shall await your advice in the
matter.
Do you think an assignment for the month of
September Will be sufficient , or would you prefer September
and October, it of course being understood that the assign-
ed judge will sit during only such portion of the time as
he may be required. It might be mentioned that assignments
are made effective from and to specific dates.
