RESOLUTION NO. 1003-A
RESOLUTION OF THE CITY COUNCIL APPROVING
AGREEMENT FOR THE ACCEPTANCE OF A PUBLIC
STREET AND SEWER EASEMENT.
THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES •
HEREBY RESOLVE AS FOLLOWS:
SECTION .1. That certain agreement between HOBART
HOMES, INC. , VIOLET MARIE LESCHORN, HELEN M. LEE, LEE
AND LESCHORN, a co-partnership, and LLOYD A. LEE and
KARL R. LESCHORN, and the CITY OF CHULA VISTA, a municipal
corporation, dated February 15th, 1949, a copy of which is
attached hereto, and incorporated herein, the same as though
fully set forth herein, be, and the same is, hereby approved.
SECTION 2. That the Mayor of the City of Chula Vista,
be, and he is hereby, authorized and directed tb execute the
same for and upon behalf of the said City upon the posting
of the bond as provided for in said agreement.
ADOPTED, SIGNED AND APPROVED this /5 day of February,

• CONTRACT FOR CO MPLETION OF IMPROVEMENTS
IT IS HEREBY AGREED by and between the CITY OF CHULA
VISTA, a municipal corporation, a City of the sixth class
and a political subdivision of the State of California, and
HOBART HOES, INC. , VIOLET Ifi.4RIE LESCHORN, HELEN M. LEE,
LEE AND LESCHORN, a co-partnership, ■and LLOYD A. LEE and
KARL R. LESCHORN, individually and as partners, jointly and
severally, hereinafter sometimes called "Owner", as follows:
h`ITNESSETH:

WHEREAS the owner is desirous of dedicating to the said
City for street purposes and as an easement for sewer purposesin
• real property described in copies of deeds of dedication
•
-- attached hereto and made a part hereof; and
WHEREAS the said City requires improvements as will here-

after appear as a condition of the said dedications; and
WHEREAS the owner is willing to perform such improvements
as a condition of acceptance by said City of said dedications
• and is willing to supply a bond guaranteeing the faithful

performance of such improvements.
NOW, THEREFORE, IT IS HEREBY AGREED by and between the
City of Chula Vista and the said owner as follows:
1. Said Owner agrees to undertake and complete within
a period of one (1) year from the date hereof all the necessary
work and installation of improvements in full conformity with

the ordinances of the City of Chula Vista, the laws of the
State of California, and the directions of proper officials
of the City of Chula Vista, California as may be applicable
•
thereto. Said improvements are more particularly described

The owner further agrees to indemnify, protect and hold
harmless the said City of Chula Vista from any and all claims
• of liability or property damage which may be made against said

• City by reason of said work and installation of improvements as
herein provided.
2. As a guarantee and as security for its full and faith-
ful performance in complying with all the requirements for the
completion of said work as aforesaid, the said owner shall deliver
•
to the said City of Chula Vista, upon the execution of this agree-
ment, a good and sufficient bond executed by an authorized surety
company satisfactory to the said City of Chula Vista in the sum
of Six thousand ($6,000.00) Dollars.
3. Upon the execution by owner of this contract and the post-
ing of the bond as herein provided, the City agrees to accept said
dedications as described in the deeds hereto att_ .ed.
