RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AGREEMENT BETWEEN THE COUNTY OF SAN DIEGO,
SOUTHWESTERN COMMUNITY COLLEGE DISTRICT, AND THE CITY OF
CHULA VISTA FOR SOUTHWESTERN COLLEGE TRANSIT CENTER
FEASIBILITY STUDY
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, in 1988, the Transit Coordinator met with representatives
from Southwestern College and the County of San Diego staff to discuss the
development of a Transit Center at Southwestern College, and
WHEREAS, in March 1989, the Southwestern College Board requested
the County of San Diego to proceed with site location analysis for a Transit
Center, and
WHEREAS, the County Board of Supervisors subsequently approved this
project in the County's Transit Center Program for a feasibility study in FY
1989-90 and tentative implementation in FY 1990~91, and
WHEREAS, a budget of $900,000 has been approved for this project
which includes $100,000 for the feasibility study and $800,000 for
construction, and
WHEREAS, the attached agreement covers the feasibility study.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Chula Vista does hereby approve an agreement between the County of San Diego,
Southwestern Community College District, and the City of Chula Vista for
Southwestern College Transit Center Feasibility Study, a copy of which is
attached hereto and incorporated herein by reference as if set forth in full.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista
be, and he is hereby authorized and directed to execute said agreement for and
on behalf of the City of Chula Vista.

AGREEMENT BETWEEN THE COUNTY OF SAN DIEGO, THE
SOUTHWESTERN COmmUNITY COLLEGE DISTRICT AND
THE CITY OF CHULA VISTA FOR THE SOUTHWESTERN COLLEGE
TRANSIT CENTER FEASIBILITY STUDY
THIS AGREEMENT iS hereby made and entered' into this 20th day
of February , 1990, by and between the COUNTY
OF SAN DIEGO, a political subdivision of the State of California, 1600
Pacific Highway, San Diego, California 92101, hereinafter referred to
as "County"; the SOUTHWESTERN COMMUNITY COLLEGE DISTRICT, a community
college district of the State of California, 900 Otay Lakes Road, Chula
Vista, California 92010, hereinafter referred to as "College"; and The
City of Chula Vista, a municipal corporation of the State of California,
276 Fourth Avenue, Chula Vista, California 92010, hereinafter referred
to as "City".
WITNESSETH
WHEREAS, under Section 99400.5 of the California Public Utilities
Code, the County was given authority to finance the construction and
maintenance of multimodal transportation terminals anywhere in the County;
and
WHEREAS, the College and City have requested County to perform
a feasibility and site location study for a Transit Center in the City
of Chula Vista at Southwestern College, hereinafter referred to as
"Transit Center"; and

WHEREAS, it is in the interest of College and City to provide input
and periodically review County's direction and progress on said
feasibility study; and
WHEREAS, the County has need of and desines to reach agreement
with the College and City in carrying out the responsibilities of all
parties for the feasibility analysis of financing, construction,
maintenance and operation of the Southwestern College Transit Center;
and
WHEREAS, the Southwestern College Transit Center project is included
for design and construction in the County's Capital Outlay Fund, the
FY 1991o95 Regional Transportation Improvement Program and in the -
Metropolitan Transit Development Board proposed FY 90-94 Short Range
Transit Plan;
NOW THEREFORE, COUNTY, COLLEGE AND CITY agree as follows:
SECTION I
COUNTY AGREES:
1) To perform a study on the feasibility of developing a Transit
Center at College, hereinafter referred to as "STUDY." Proposed
STUDY Work Plan and outline is attached as Exhibit "A".
2) To perform STUDY with COUNTY staff and consultant at no direct
cost to either CITY or COLLEGE.

3) To file a claim for an allocation of one hundred thousand dollars
{$100,000) from the County's current apportionment in the
Transportation Development Act (TDA) fund for the purpose of
performing STUDY.
4) To act as STUDY Project Manager, and staff to the STUDY Technical
Advisory Committee.
5) To utilize a STUDY Technical Advisory Committee composed of
COUNTY, CITY and COLLEGE staff representatives to guide the
development and direction of STUDY.
6) To act as lead agency according to Section 21067 of the Public
Resources Code which defines the lead agency as "the public
agency which has the principal responsibility for carrying out
or approving a project which may have a significant effect upon
the environment "during the preparation of an approved
environmental document.
7) To publish STUDY upon the review of STUDY Technical Advisory
Committee.
8) To submit final STUDY upon completion, and any STUDY
recommendations to County Board of Supervisors, City Council
and College Board of Trustees for their information and possible
action.

SECTION II
CO[LE8E AGREES:
1) To provide technical information and staff support as necessary
to assist COUNTY in the performance of STUDY.
2) To provide representation on the STUDY Technical Advisory
Committee to guide the development and direction of STUDY.
3) To submit final STUDY upon completion, and any STUDY
recommendations to College Board of Trustees for their information
and possible action.
SECTION III
CITY AGREES:
1) To provide technical information and staff support as necessary
to assist COUNTY in the performance of STUDY.
2) To provide representation on the STUDY Technical Advisory
.Committee to guide the development and direction of STUDY.
3) To submit final STUDY upon completion, and any STUDY
recommendations, to CITY Council for their information and
possible action.

SECTION IV
IT IS MUTUALLY AGREED:
1) That overall STUDY management shall be-the responsibility of
COUNTY.
2) The final STUDY format and content shall be in accordance with
the direction of the STUDY Technical Advisory Committee.
3) All STUDY work performed by COUNTY staff shall be reviewed by
the STUDY Technical Advisory Committee prior to publication.
4) STUDY may be terminated prior to completion if COUNTY, CITY
and COLLEGE agree in writing that continuation of STUDY work
would not produce beneficial results commensurate with staff
effort and expense.
5) CITY, COLLEGE and COUNTY shall comply with the requirements
of their respective Affirmative Action/Equal Opportunity Programs
in the performance of this STUDY.
6) This Agreement shall terminate upon completion of STUDY or upon
mutual written agreement by COUNTY, CITY and COLLEGE to terminate
STUDY.

7) This Agreement may not be modified, amended or otherwise changed
unless by an amendment in writing executed by the COUNTY, CITY
and COLLEGE.
8) Any notice required or permitted under this Agreement may be
personally served on the other parties, by the party giving
notice, or may be served by certified mail, return receipt
requested, to the following addresses:

COLLEGE TRANSIT CENTER
WORK STATEMENT: Study will: (1)- Inventory existing
transportation services and facilities provided in the College
vicinity, (2) Identify current usage of existing facilities,
and forecast future needs for a Transit Center, (3) Estimate
future public usage of the Transit Center, (4) Develop a
functional site plan and concept design for the facility, (5)
Estimate capital and operating costs, (6) Identify funding
sources, (7) Prepare preliminary environmental analysis, and
(8) Study recommendations.
