WHEREAS. Citv of San Dieso is en�ased in the acti��it�� of conve��ins ���ater to the
em irons of Cit�� of San Dieeo. State of Califomia: and �
W'HEREAS. cenain water conve��ance facilities o��roed bv San Dieso are located within
Chula Vista, and on occasion, development within Chula Vista mav be in conflict ��ith San
Dieoo`s N�ater transportation facilities; and
«"HEREAS, Bald"�in and Sons, LLC. (Bald���in); a developer of a certain real property
«ithin Chula Vista, ���ishes to de��elop certain properties commonh� kno��n as Otay Ranch
Villaee 3: and
V�'HEREAS, Ota�� Ranch Villaee 2 de��elopment is in conflict ���ith certain ��ater
transportation facilities o�vned and operated b�� San Diego ("Ota�� Pipeline 2"); and
WHEREAS; as a condition of the appro��al of Baldwin's Subdivision Tentati��e Map,
Baldwin is required to relocate Otay Pipeline 2 into an area described in E�hibit "A" and sho«m
on Exhibit "B" attached hereto, �ti�hich eshibits are incorporated herein by this reference. The
areas described on E�hibit "A" and sho��m on Exhibit `B" are hereinafter referred to as "Joint
Use Area ': and
WHEREAS, San Dieeo is �+�illin� to allo�i�the relocation of Ota�� Pipeline 2 into the Joint
Use Area and will thereafrer operate and maintain the pipeline and its associated Facilities located
in. under and across that certain rieht-of-wa�� dedicated to the Cit�= of Chula Vista b�� Bald�vin as
Olvmpic Parkwa}� and La Media Road on propem� located in San Diego Count��_ California; and
R'HEREAS, Chula Vista desires to construct. operate and maintain a future reeional
public transportation facilit�� and related impro��ements. includin� but not limited to: se���er and
storm drain pipelines and appurtenances, traffic signals and sivnal interconnections, irrigation
lines and imgation control devices located in, upon, o��er. under and across Oh�mpic Parkwa��
and La Media Road riehts-of-«�a��: and
WHEREAS. Bald���in ���ill perform the actual relocation of Ota�� Pipeline 2 ���hich will
result in the placement of Ota�� Pipeline 2 within the Joint Use Area; and

WHEREAS, Chula Vista and San Diego desire to enter into a joint use agreement to set
forth their respecti��e rights and obligations in the event of actual or potential present or fumre
conflicts in the construction; operation or maintenance of their respective facilities ��ithin the
Joint Use Area.
NOW, THEREFORE; BE IT RESOLVED by the City Council of the City of Chula Vista
that it does hereby appro��e the Joint Use Agreement, with such minor, nonsubstantive alterations
as ma}� be required by the City Attorney, and authorize the City Manager or his Designee to
execute said agreement on behalf oFthe City of Chula Vista.
